General Comments: This notice was originally made under subsection 65C(7) of the Trade Practices Act 1974. Item 3 of Schedule 7 to the Trade Practices Amendment (Australian Consumer Law) Act (No. 2) 2010 (Act No. 103 of 2010) provides that this notice remains in force from 1 January 2011 as if it had been made under section 114 of the Australian Consumer Law (as set out in Schedule 2 of the Competition and Consumer Act 2010 (Act No. 51 of 1974)).

Note: the Trade Practices Act 1974 was renamed the Competition and Consumer Act 2010 on 1 January 2011 (see item 2 of Schedule 5 to the Trade Practices Amendment (Australian Consumer Law) Act (No. 2) 2010 (Act No. 103 of 2010)).

Consumer Protection Notice No 10 of 1991

 

PERMANENT BAN ON GOODS

 

I, MICHAEL CARTER TATE, Minister of State for Justice and Consumer Affairs, pursuant to section 65C(7) of the Trade Practices Act 1974, IMPOSE a permanent ban on goods of a kind specified below (‘the goods’).

 

The effect of this Notice is to ban the supply of these goods in trade or commerce, by a corporation (and, in some cases, by an individual).

 

Particulars of Goods:  Chewing tobacco and snuffs intended for oral use.
