
FMA Act Determination 2009/11 — Section 32 (Transfer of Functions from BA to DAFF)
Financial Management and Accountability Act 1997
I, Greg Feeney, Acting Division Manager, Financial Reporting and Cash Management Division, Department of Finance and Deregulation, make this Determination under subsection 32 (2) of the Financial Management and Accountability Act 1997 (the FMA Act).
This Determination is made because on 1 July 2009 Biosecurity Australia was removed as an agency under the Financial Management and Accountability Act 1997. As a consequence, the functions performed by Biosecurity Australia were transferred to the Department of Agriculture, Fisheries and Forestry.

1 Name of Determination
This Determination is the FMA Act Determination 2009/11 — Section 32 (Transfer of Functions from BA to DAFF).
Note 1 This Determination has been made by a delegate of the Secretary of the Department of Finance and Deregulation. The Secretary is a delegate of the Minister for Finance and Deregulation: see sections 53 and 62 of the FMA Act.
Note 2 Acronyms and other organisational names used in this Determination are as follows:
(a) “BA” – refers to Biosecurity Australia.
(b) “DAFF” – refers to the Department of Agriculture, Fisheries and Forestry.
2 Commencement
This Determination commences, or is taken to have commenced, as follows:
(a) on 11 February 2005 - sections 1, 2 and 3 and Schedule 1;
(b) on 1 July 2009 - sections 4, 5, 6, 7 and 8 and Schedules 2, 3, 4, 5 and 6.
Note Under subsection 32(8) of the FMA Act, a Determination may be expressed to take effect before its making and registration under the Legislative Instruments Act 2003.
3 Amendment of Appropriation Act (No. 1) 2004–2005
Schedule 1 amends the Appropriation Act (No. 1) 2004–2005 to transfer an amount of $6,967,455.00 of the departmental item for the Department of Agriculture, Fisheries and Forestry to the departmental item for Biosecurity Australia.
Note The amount transferred relates to the transfer of functions, including import risk assessment, previously performed by the Department of Agriculture, Fisheries and Forestry to Biosecurity Australia.
4 Amendment of Appropriation Act (No. 1) 2004–2005
Schedule 2 amends the Appropriation Act (No. 1) 2004–2005 to transfer an amount of $3,289,248.32 of the departmental item for Biosecurity Australia to the departmental item for the Department of Agriculture, Fisheries and Forestry.
Note The amount transferred relates to the functions performed by Biosecurity Australia and the transfer of those functions to the Department of Agriculture, Fisheries and Forestry.
5 Amendment of Appropriation Act (No. 1) 2005–2006
Schedule 3 amends the Appropriation Act (No. 1) 2005–2006 to transfer an amount of $141,882.30 of the departmental item for Biosecurity Australia to the departmental item for the Department of Agriculture, Fisheries and Forestry.
Note The amount transferred relates to the functions performed by Biosecurity Australia and the transfer of those functions to the Department of Agriculture, Fisheries and Forestry.
6 Amendment of Appropriation Act (No. 1) 2007–2008
Schedule 4 amends the Appropriation Act (No. 1) 2007–2008 to transfer an amount of $683,099.53 of the departmental item for Biosecurity Australia to the departmental item for the Department of Agriculture, Fisheries and Forestry.
Note The amount transferred relates to the functions performed by Biosecurity Australia and the transfer of those functions to the Department of Agriculture, Fisheries and Forestry.
7 Amendment of Appropriation Act (No. 1) 2008–2009
Schedule 5 amends the Appropriation Act (No. 1) 2008–2009 to transfer an amount of $1,040,692.56 of the departmental item for Biosecurity Australia to the departmental item for the Department of Agriculture, Fisheries and Forestry.
Note The amount transferred relates to the functions performed by Biosecurity Australia and the transfer of those functions to the Department of Agriculture, Fisheries and Forestry.
8 Amendment of Appropriation Act (No. 1) 2009–2010
Schedule 6 amends the Appropriation Act (No. 1) 2009–2010 to transfer an amount of $21,440,000.00 of the departmental item for Biosecurity Australia to the departmental item for the Department of Agriculture, Fisheries and Forestry.
Note The amount transferred relates to the functions performed by Biosecurity Australia and the transfer of those functions to the Department of Agriculture, Fisheries and Forestry.
