This Declaration provides a range of equivalent occupations across States and Territories and stems from a decision of the Council of Australian Governments (COAG) in February 2006 requesting the implementation of full and effective mutual recognition of occupational licences for vocationally-trained occupations. It covers a number of occupations identified as priority occupations and it is intended that other vocationally-trained occupations will be included in later declarations.

MUTUAL RECOGNITION ACT 1992 – Section 32

 

Ministerial Declaration

 

To give effect to the express wish of the Council of Australian Governments (COAG) for full and effective mutual recognition of registered occupations, we the ministers today responsible jointly declare that:

 

The occupation which may be carried on only by a person granted registration (in the form of a licence, certificate, registration, or other instrument) in the first jurisdiction described in Column A in the attached Schedule is equivalent to the occupation which may be carried on only by a person granted registration in a second jurisdiction as described in the other columns of the same row in the Schedule, subject to any conditions, limitations or restrictions as indicated.

1.                            Name of declaration

                 This Declaration is the Mutual Recognition (Maritime and Other Occupations) Declaration 2009.

2.                            Commencement

                 This Declaration commences on the day after it is registered.

3.                            Interpretation

(1)    In this Declaration:

Registration includes a licence, approval, admission, certificate or any other form of authorisation.

Schedule means a schedule to this Declaration.

Part 2      Maritime Occupations

4.                            Interpretation of Part and associated Schedule

(1)    In this Part and in Schedules 1 to 3:

Endorsement means a provision of a registration that expands the activities authorised to be carried out under that registration, including an endorsement relating to:

§          vessel type;

§          vessel size;

§          engine power;

§          operational area; or

§          special purpose operations such as hovercraft or sailing vessel operations.

Government vessel means a vessel operated by a Department or authority of a State, Territory or the Commonwealth for any purpose.

Inshore operations limit means the limit specified in the definition of inshore operations in clause 1.8 of Part B of the NSCV.

NSCV means the National Standard for Commercial Vessels adopted by the conference of Commonwealth, New Zealand, State, Australian Capital Territory and Northern Territory Ministers known as the Australian Transport Council.

Operational area includes Australian coastal and middle water operations inshore operations and sheltered waters (as defined in clause 1.8 of Part B of the NSCV), offshore operations, restricted offshore operations, partially smooth water operations and smooth water operations (as defined in clause 3.4 of Part B of the NSCV) and offshore (100 nautical miles) and unlimited (as set out in Table A.1 of Part D of the NSCV).

Restriction means a provision of a registration that limits the activities authorised to be carried out under that registration, including a restriction relating to:

operation in day light hours;

vessel size

engine power; and

operational area.

Sheltered waters has the meaning given in clause 1.8 of Part B of the NSCV.

Smooth water operations has the meaning given in clause 1.8 Part B of the NSCV.

USLC means the Uniform Shipping Laws Code adopted by the conference of Commonwealth, New Zealand, State, Australian Capital Territory and Northern Territory Ministers known as the Australian Transport Council.

Vessel type means a trading vessel as defined in clause 1.5 of Part D of the NSCV and a fishing vessel as defined in clause 1.8 of Part B of the NSCV.

5.                            Equivalent maritime occupations where no restrictions or endorsements

(1)    Subject to sections 6 and 7, the occupation which may be carried on only by a person granted a registration, in the jurisdiction, described in Column A of Schedules 1 to 3 (first jurisdiction) is equivalent to the occupation which may be carried on only by a person granted a registration, in a jurisdiction, described in the other columns of the same row in the relevant Schedule (second jurisdiction), subject to any conditions, limitations or restrictions indicated in the relevant Schedule.

6.                            Equivalent maritime occupations where restrictions or endorsements

(1)    Subject to section 7, where the registration for an occupation described in Column A of Schedules 1 to 3 (first jurisdiction) contains one or more restrictions or endorsements, the occupation which may be carried on only by a person holding such a registration is, subject to any conditions indicated in the relevant Schedule, equivalent to the occupation which may be carried on by a person granted a registration, in a jurisdiction, described in the same row (second jurisdiction), where the registration in the second jurisdiction:

replicates exactly all endorsements (if any); and

subject to subsection (2), in relation to each restriction (if any), either:

(a)      does not include the restriction;

(b)      exactly replicates the restriction; or

(c)      if the restriction contained in the registration issued by the first jurisdiction relates to vessel size, operational area or engine power (except outboard motor power), includes a modified restriction that converts the restriction contained in the registration issued by the first jurisdiction upwards to the nearest:

(i)            category of vessel size specified in Table A.1 of Part D of the NSCV;

(ii)          operational area specified in clause 1.8 of Part B of the NSCV, clause 3.4 of Part B of the NSCV and Table A.1 of Part D of the NSCV, that is:

§          Unlimited

§          Australian Coastal and Middle Waters (600 nautical miles)

§          Offshore (200 nautical miles)

§          Restricted offshore (100 nautical miles)

§          Restricted offshore (30 nautical miles)

§          Inshore (15 nautical miles)

§          Sheltered waters;

or

(iii)       category of engine power specified Table A.2 of Part D of the NSCV.

(2)    If the restriction contained in the registration issued by the first jurisdiction permits a person to operate a vessel outside sheltered waters, but does not allow that person to operate a vessel as far as the inshore operations limit, the registration in the second jurisdiction is only equivalent where it includes a modified restriction that prevents the registration holder from operating a vessel more than 5 nautical miles seaward from point of departure and 30 nautical miles laterally along the coast from point of departure.

(3)    For the purposes of subsection (1):

(a)   restrictions and endorsements imposed are to be construed with any necessary adaptations, including the following:

(i)    references to the first jurisdiction are to be read as references to the second jurisdiction;

(ii)   references to officers or authorities of the first jurisdiction are to be read as references to corresponding officers or authorities of the second jurisdiction;

(iii)   references to specific locations in the first jurisdiction are to be read as references to generic locations.

Note:  For example, where a registration issued in the first jurisdiction restricts the holder to operating within a named harbour, the restriction should be adapted to restrict the holder to operating within a safe haven or port in the second jurisdiction.

(b)     references to inland water operations are to be treated as references to smooth water operations.

7.                            Circumstances where sections 5 and 6 do not apply

(1)    Sections 5 and 6 do not apply where:

(a)     a person was registered for an occupation described in Schedules 1 to 3 prior to the adoption of the USLC in the relevant jurisdiction;

(b)     a person was registered for an occupation described in Schedules 1 to 3 after the adoption of the USLC in the relevant jurisdiction, but the registration was granted during the transition to the USLC and was granted on the basis of conditions in place prior to the adoption of the USLC (except in relation to New South Wales registrations specifically identified in  Schedule 1, 2 or 3); or

(c)     a person is registered for an occupation, and the registration contains a restriction, or other provision, relating to operation of government vessels.

(d)     a restriction or endorsement relates to a specific geographic hazard that is unique to the first jurisdiction.

Note  Where section 7 applies, the relevant person may still seek registration in a second jurisdiction in accordance with the Mutual Recognition Act 1992. Such applications will be assessed by the applicable registration authority in accordance with the requirements of the Mutual Recognition Act 1992 that apply where no declaration under section 32 has been made.

8.                            Declaration not to limit powers of a registration authority

(1)    Nothing in this Part is intended to affect the powers, under the Mutual Recognition Act 1992, of a registration authority in a second jurisdiction to impose conditions on a registration, other than conditions that relate to the activities authorised to be carried out under the registration.

Note  For example, a registration authority in a second jurisdiction could impose a condition relating to insurance requirements, but could not impose a condition that restricted the activities authorised by the registration (unless that condition is expressly authorised by this Declaration).

 

Part 3        Casino and Gaming Occupations

9.                            Equivalent casino occupations

(1)    Subject to subsection (2), the occupation which may be carried on only by a person granted a registration, in the jurisdiction, described in Column A of Schedule 4 (first jurisdiction) is equivalent to the occupation which may be carried on only by a person granted a registration, in a jurisdiction, described in the same row of Schedule 4 (second jurisdiction), subject to any conditions, limitations or restrictions indicated in Schedule 4.

(2)    The occupation which may be carried on only by a person granted a registration, in the jurisdiction, described in Rows 3, 5, 9, 10, 13, 14, 18, 21,24, 27 and 28 of Column A of Schedule 4 (first jurisdiction) is, subject to any conditions, limitations or restrictions indicated in Schedule 4, equivalent to the occupation which may be carried on only by a person granted a registration, in the jurisdiction, described in the same row of Schedule 4 (second jurisdiction), where the registrations issued by both jurisdictions authorise the same activity, or same combination of listed activities, below:

(a)       casino management;

(b)       casino executive management;

(c)       the conduct of gaming;

(d)       gaming machine;

(e)       keno gaming;

(f)         the maintenance, construction, or repair of gaming equipment;

(g)       the maintenance or repair of security and surveillance equipment;

(h)       the maintenance and support of computer systems in the casino;

(i)         the movement of money or chips about the casino (other than in relation to the supply of food and beverages);

(j)         the storage and exchange of money or chips to patrons in the casino (other than in relation to the supply of food and beverages);

(k)       the counting of money or chips in the casino (other than in relation to the supply of food and beverages);

(l)         cash and accounting (other than in relation to the supply of food and beverages);

(m)     internal audit operations;

(n)       the storage of gaming equipment in the casino;

(o)       casino promotions (if this is PR);

(p)       security operations;

(q)       surveillance operations;

(r)         administrative and incidental operations.

(3)    For the purposes of subsection (2), where a registration issued by the first jurisdiction does not identify the activities authorised by the registration, the registration is deemed to authorise only the activities in fact carried out by the registration holder in the first jurisdiction.

10.                         Declaration not to limit powers of a registration authority

(1)    Nothing in this Part is intended to affect the powers, under the Mutual Recognition Act 1992, of a registration authority in a second jurisdiction to impose conditions on a registration, other than conditions that relate to the activities authorised to be carried out under the registration.

Part 4      Shotfirers and Pyrotechnicians, Pest and Weed Controllers, Building Occupations, Builders (2006 Update)

11.                         Equivalent occupations Shotfirers and Pyrotechnicians, Pest and Weed Controllers, Building Occupations, Builders (2006 Update)

 (1)   The occupation which may be carried on only by a person granted a registration, in the jurisdiction, described in Column A of the Schedule (first jurisdiction) is equivalent to the occupation which may be carried on only by a person granted a registration, in a jurisdiction, described in the same row of the Schedule (second jurisdiction), subject to any conditions, limitations or restrictions indicated in the Schedule.

12.                         Declaration not to limit powers of a registration authority

(1)    Nothing in this Part is intended to affect the powers, under the Mutual Recognition Act 1992, of a registration authority in a second jurisdiction to impose conditions on a registration, provided that the conditions imposed do not relate to the activities authorised to be carried out under the registration unless such conditions applied to the person's registration in the first jurisdiction.

 

 


 

Notes:

 

The table at the attached Schedule depicts the registration outcome for any person already licensed in an occupation in a particular jurisdiction (column A of each row) should they seek to be licensed in an occupation in a second jurisdiction (potentially in any other column in the same row). Registration shall be granted by the second jurisdiction in the terms specified provided the applicant is already registered in the equivalent occupation in the first jurisdiction.

If a licence is not included in the declaration, or if the licence outcome depicted on the Schedule is the statement ‘No equivalent declared’, the decision on licence recognition will be made by the relevant registration authority in accordance with the other provisions of the Mutual Recognition Act 1992.

Licences covered by this declaration are licences that are issued to natural persons, not licences issued to companies.

This declaration and any subsequent declarations will be reviewed for accuracy each year. Declarations and any revised declarations will be published on the COAG mutual recognition website and the websites of the relevant licensing authorities.

Work conducted in relation to the assembly, positioning and detonation of explosives to break or dislodge rock and soil or to demolish structures, conduct seismic testing, or other special purposes. This work also includes:

-          Check blasting areas to ensure compliance with regulations, standards and other applicable licence conditions

-          Ensuring explosives are authorised, as per the competent authority, and within shelf life

-          Preparation of a blast management plan

-          Determining and maintaining the exclusion zone
