These Regulations amend the National Health (Pharmaceutical Benefits) Regulations 1960 to set out the fees and allowances payable to the chair and members of DUSC and ESC and provides for new pricing arrangements to enable the Government to capture the benefits of competition where subsidised drugs have multiple brands.

I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the National Health Act 1953.

1              Name of Regulations

                These Regulations are the National Health (Pharmaceutical Benefits) Amendment Regulations 2009 (No. 1).

2              Commencement

                These Regulations commence on 31 July 2009.

3              Amendment of National Health (Pharmaceutical Benefits) Regulations 1960

                Schedule 1 amends the National Health (Pharmaceutical Benefits) Regulations 1960.


Schedule 1        Amendments

(section 3)

 

[1]           After regulation 37J

insert

37K         Price reduction — prescribed reduction day

                For subsection 99ADH (2) of the Act, the reduction day is 1 April or 1 August in any year.

[2]           Regulation 38, after definition of Committee

insert

Drug Utilisation Sub-Committee means the sub-committee of that name established under section 101A of the Act.

Economics Sub-Committee means the sub-committee of that name established under section 101A of the Act.

[3]           After regulation 47

insert

48            Remuneration for chair and members of sub-committees

                For paragraph 140 (a) of the Act, the fees and allowances payable to the chair and members of the Drug Utilisation Sub‑Committee and the Economics Sub‑Committee are the amounts that are payable to the chair and members of professional committees under Schedule B to the Remuneration Tribunal Determination 2008/07: Remuneration and Allowances for Holders of Part-Time Public Office.
