I, QUENTIN BRYCE, Governor‑General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fair Work Act 2009.

1              Name of Regulations

                These Regulations are the Fair Work (Oath and Affirmation) Regulations 2009.

2              Commencement

                These Regulations commence on 26 May 2009.

3              Definitions

                In these Regulations:

Act means the Fair Work Act 2009.

4              President of FWA — oath and affirmation of office

         (1)   For section 634 of the Act, the oath and affirmation for the President of FWA are set out in Schedule 1.

         (2)   The oath or affirmation must be taken before:

                (a)    the Governor‑General; or

               (b)    a Justice of the High Court; or

                (c)    a Judge of the Federal Court; or

               (d)    a Judge of the Supreme Court of a State or a Territory.

Oath

I, [name], do swear that I will bear true allegiance to Her Majesty Queen Elizabeth the Second, Her Heirs and Successors according to law, that I will well and truly serve Her in the office of President of Fair Work Australia and that I will faithfully and impartially perform the duties of the office. So help me God!

Affirmation

I, [name], do solemnly and sincerely promise and declare that I will bear true allegiance to Her Majesty Queen Elizabeth the Second, Her Heirs and Successors according to law, that I will well and truly serve Her in the office of President of Fair Work Australia and that I will faithfully and impartially perform the duties of the office.
