1.1Â Â Â Â Â Â Â Â Â Â Name of Determination [see Note 1]
               This Determination is the Radiocommunications Licence Conditions (Maritime Ship Licence) Determination 2002.
1.2Â Â Â Â Â Â Â Â Â Â Commencement [see Note 1]
               This Determination commences on gazettal.
1.3          Radiocommunications Licence Conditions (Maritime Ship Licence) Determination No 1 of 1997 — repeal
               Radiocommunications Licence Conditions (Maritime Ship Licence) Determination No 1 of 1997, notified in the Gazette on 9 July 1997, is repealed.
1.4Â Â Â Â Â Â Â Â Â Â Definitions
        (1)  In this Determination:
AMSA means the Australian Maritime Safety Authority.
calling means operating a maritime ship station to establish contact with another station.
commercial operations means the activities of commercial vessels (other than professional fishing and port operations).
distress, in relation to a transmission, means that a ship, aircraft or person is threatened by grave and imminent danger and requires immediate assistance.
DSC (also known as digital selective calling) means a digital system of communications used for the following purposes:
               (a)   transmitting distress alerts from ships;
              (b)   transmitting acknowledgments of distress alerts from shore stations;
               (c)   relaying distress alerts;
              (d)   transmitting alerts prior to the broadcast of urgency and safety messages.
Note The transmission of a distress alert indicates that a ship is threatened by grave and imminent danger, and is requesting immediate assistance. A distress alert is a digital selective call, using a distress call format, that provides the identification of the station in distress and its position.
Inmarsat means International Maritime Satellite Organisation.
inshore boating radio service means a maritime mobile service between a limited coast station and a maritime ship station operating in inshore waters or inland waterways.
LCMRS means limited coast marine rescue station.
LCS means any of the following stations:
               (a)   a maritime coast station operating as part of a limited coast assigned system;
              (b)   a limited coast non assigned station;
               (c)   a limited coast marine rescue station.
licence means:
               (a)   a maritime ship licence (ship station Class A); or
              (b)   a maritime ship licence (ship station Class B assigned); or
               (c)   a maritime ship licence (ship station Class B non assigned); or
              (d)   a maritime ship licence (ship station Class C assigned); or
               (e)   a maritime ship licence (ship station Class C non assigned).
licensee means the holder of a licence, and includes any person authorised by the licensee to operate a station under the licence.
maritime ship licence (ship station Class A) means a maritime ship licence authorising the holder to operate a ship station Class A.
maritime ship licence (ship station Class B assigned) means a maritime ship licence authorising the holder to operate a ship station Class B assigned.
maritime ship licence (ship station Class B non assigned) means a maritime ship licence authorising the holder to operate a ship station Class B non assigned.
maritime ship licence (ship station Class C assigned) means a maritime ship licence authorising the holder to operate a ship station Class C assigned.
maritime ship licence (ship station Class C non assigned) means a maritime ship licence authorising the holder to operate a ship station Class C non assigned.
MCS means major coast station.
NBDP means narrow-band direct-printing.
non-commercial operations means maritime operations other than:
               (a)   commercial operations; and
              (b)   port operations; and
               (c)   professional fishing operations.
port operations means activities relating to the operational handling, movement and navigation of ships in, or near, a port.
professional fishing operations, in relation to a station operated under a licence, means the licensee’s professional fishing activities.
radiodetermination communications means communications:
               (a)   for determining 1 or more of the following:
                         (i)   the position of an object;
                        (ii)   the velocity of the object;
                        (iii)   other characteristics of the object; or
              (b)   for obtaining information allowing a person to determine any of the matters.
relevant document, for a maritime ship station, means the document:
               (a)   that was published most recently before the station was manufactured or imported; and
              (b)   as in force when the station was manufactured or imported.
safety, in relation to a transmission, means the safety of navigation or providing an important meteorological warning.
SAR means search and rescue.
TOR means telex-on-radio.
urgency means that urgent attention to the safety of a ship, aircraft or person is required.
working means operating a maritime ship station to exchange messages with another station.
Note 1 For the definition of Automatic Identification System (AIS), see the Radiocommunications (Interpretation) Determination 2000.
Note 2 For definitions of other expressions used in this Determination, see the Radiocommunications Act 1992, the Radiocommunications Regulations 1993 and the Radiocommunications (Interpretation) Determination 2000.
        (2)  For this Determination, a frequency band described using 2 frequencies starts immediately above the lower frequency and ends at the higher frequency.
1.5Â Â Â Â Â Â Â Â Â Â Structure of Determination
        (1)  Part 2 of this Determination sets out conditions that apply to the operation, under a licence, of:
               (a)   a maritime ship licence (ship station Class A); or
              (b)   a maritime ship licence (ship station Class B assigned); or
               (c)   a maritime ship licence (ship station Class B non assigned); or
              (d)   a maritime ship licence (ship station Class C assigned); or
               (e)   a maritime ship licence (ship station Class C non assigned).
        (2)  Part 3 of this Determination sets out additional conditions that apply to the operation, under a licence, of a maritime ship licence (ship station Class A).
        (3)  Part 4 of this Determination sets out additional conditions that apply to the operation, under a licence, of a maritime ship licence (ship station Class B non assigned).
        (4)  Part 5 of this Determination sets out additional conditions that apply to the operation, under a licence, of a maritime ship licence (ship station Class C assigned).
        (5)  Part 6 of this Determination sets out additional conditions that apply to the operation, under a licence, of a maritime ship licence (ship station Class C non assigned).
        (6)  However, if a condition in this Determination is inconsistent with a condition specified in the licence, the condition specified in the licence applies.
Part 2Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Conditions that apply to the operation of stations
2.1Â Â Â Â Â Â Â Â Â Â Application of Part 2
        (1)  For paragraph 107 (1) (f) of the Act, the operation, under a licence, of any of the following stations is subject to the conditions in this Part:
               (a)   a maritime ship licence (ship station Class A);
              (b)   a maritime ship licence (ship station Class B assigned);
               (c)   a maritime ship licence (ship station Class B non assigned);
              (d)   a maritime ship licence (ship station Class C assigned);
               (e)   a maritime ship licence (ship station Class C non assigned).
        (2)  The conditions in this Part are additional to the conditions in other Parts of this Determination.
2.2Â Â Â Â Â Â Â Â Â Â Technical requirements
        (1)  If a maritime ship station includes MF or HF international maritime mobile service equipment, the station must comply with the requirements of the relevant document in Part 1 of Schedule 1.
        (2)  If a maritime ship station includes 27 MHz inshore boating radio service equipment, the station must comply with the requirements of the relevant document in Part 2 of Schedule 1.
        (3)  If a maritime ship station includes VHF international maritime mobile service equipment, the station must comply with the requirements of the relevant document in Part 3 of Schedule 1.
        (4)  If a maritime ship station includes equipment designed to be operated on a lifeboat, the station must comply with the requirements of the relevant document in Part 4 of Schedule 1.
        (5)  If a maritime ship station includes equipment designed to be operated on a ship earth installation, the station must comply with the requirements of the relevant document in Part 5 of Schedule 1.
        (6)  If a maritime ship station includes a main ship MF radiotelegraph transmitter, the station must comply with the requirements of the relevant document in Part 6 of Schedule 1.
        (7)  If a maritime ship station includes a reserve ship MF radiotelegraph transmitter, the station must comply with the requirements of the relevant document in Part 7 of Schedule 1.
        (8)  If a maritime ship station includes a main ship radiotelegraph and radiotelephone receiver, the station must comply with the requirements of the relevant document in Part 8 of Schedule 1.
        (9)  If a maritime ship station includes a reserve ship radiotelegraph and radiotelephone receiver, the station must comply with the requirements of the relevant document in Part 9 of Schedule 1.
      (10)  If a maritime ship station includes an automatic keying device on a ship, the station must comply with the requirements of the relevant document in Part 10 of Schedule 1.
      (11)  If a maritime ship station includes a ship radiotelegraph auto-alarm, the station must comply with the requirements of the relevant document in Part 11 of Schedule 1.
      (12)  If a maritime ship station includes a ship radiotelephone alarm signal generating device, the station must comply with the requirements of the relevant document in Part 12 of Schedule 1.
      (13)  If a maritime ship station includes a ship radiotelephone distress frequency watch receiver, the station must comply with the requirements of the relevant document in Part 13 of Schedule 1.
      (14)  If a maritime ship station includes UHF on-board communication equipment, the station must comply with the requirements of the relevant document in Part 14 of Schedule 1.
      (15)  If a maritime ship station includes Automatic Identification System (AIS) equipment, the station must comply with the requirements of the relevant document in Part 15 of Schedule 1.
2.3Â Â Â Â Â Â Â Â Â Â Location of station
               A maritime ship station must not be operated on land.
2.4Â Â Â Â Â Â Â Â Â Â Qualified operator
        (1)  A person who operates a maritime ship station (except a ship station Class A) must be, or must be under the supervision of:
               (a)   a qualified operator; or
              (b)   the holder of an Australian Maritime Authority Global Maritime Distress and Safety Certificate issued under the Part 6 (Marine Qualifications — Radio) of the Marine Orders made under the Navigation Act 1912; or
               (c)   a person holding qualifications recognised by AMSA as equivalent qualifications for the station
        (2)  A person who operates a maritime ship station (except a ship station Class A) on an MF or HF maritime frequency band must be, or must be under the supervision of:
               (a)   a qualified operator who holds at least 1 of the following certificates:
                         (i)   a Restricted Radiotelephone Operator’s Certificate of Proficiency (RROCP);
                        (ii)   a Marine Radio Operator’s Certificate of Proficiency (MROCP); or
              (b)   the holder of an Australian Maritime Safety Authority Global Maritime Distress and Safety Certificate issued under Part 6 (Marine Qualifications — Radio) of the Marine Orders made under the Navigation Act 1912; or
               (c)   a person holding qualifications recognised by AMSA as equivalent qualifications for the station.
        (3)  A person who operates a maritime ship station (except a ship station Class A) on a VHF maritime frequency band must be, or must be under the supervision of:
               (a)   a qualified operator who holds at least 1 of the following certificates:
                         (i)   a Restricted Radiotelephone Operator’s Certificate of Proficiency (RROCP);
                        (ii)   a Marine Radio Operator’s Certificate of Proficiency (MROCP);
                        (iii)   a Marine Radio Operator’s VHF Certificate of Proficiency (MROVCP); or
              (b)   the holder of an Australian Maritime Safety Authority Global Maritime Distress and Safety Certificate issued under Part 6 (Marine Qualifications — Radio) of the Marine Orders made under the Navigation Act 1912; or
               (c)   a person holding qualifications recognised by AMSA as equivalent qualifications for the station.
        (4)  For this section, a station is operated under the supervision of a person if the person is at the station when it is operated.
Note A person who operates a limited coast assigned system station exclusively on the 27 MHz marine band is not required to be, or be under the supervision of:
·     a qualified operator; or
·     a person holding particular operator qualifications.
However, in the interests of safety, the ACA recommends strongly that the person obtains at least the Marine Radio Operators VHF Operators Certificate of Proficiency (MROVCP).
2.5Â Â Â Â Â Â Â Â Â Â Operation outside Australia
        (1)  The licensee of a maritime ship station operating outside the territorial sea of Australia must operate the station in accordance with:
               (a)   the Radio Regulations; and
              (b)   if the station is in the territorial sea of another country — the radiocommunications requirements of the country.
        (2)  If a maritime ship station is to be operated outside Australia on a frequency specified in the Manual for use by the Maritime Mobile and Maritime Mobile-Satellite Services, published by the International Telecommunication Union and as in force from time to time, the licensee must only operate the station to communicate with one of the following stations:
               (a)   a coast station operated in another country;
              (b)   a coast earth station operated in another country;
               (c)   a ship earth station;
              (d)   a ship station.
2.6Â Â Â Â Â Â Â Â Â Â Call signs
               At the start of each transmission or series of transmissions, the licensee of a maritime ship must transmit:
               (a)   the call sign allocated by the ACA; or
              (b)   another form of identity that clearly identifies the station; or
               (c)   for a station using DSC facilities — the maritime mobile service identity.
2.7Â Â Â Â Â Â Â Â Â Â Maritime ship stations and AIS frequencies
               A person must operate a maritime ship station on the following frequencies only in accordance with Part 11 of Schedule 3.
               (a)   161.975 MHz;
              (b)   162.025 MHz.
Part 3Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Additional conditions for the operation of ship stations Class A
3.1Â Â Â Â Â Â Â Â Â Â Application of Part 3
        (1)  For paragraph 107 (1) (f) of the Act, the operation, under a licence, of a ship station Class A is subject to the conditions in this Part.
        (2)  The conditions in this Part are additional to the conditions in Part 2.
3.2Â Â Â Â Â Â Â Â Â Â Operating requirements
               A licensee must not operate a ship station Class A unless it is operated:
               (a)   on a frequency mentioned in column 2 of an item in Schedule 2; and
              (b)   using a transmitter output power not more than the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   to send or receive a communication as part of an activity mentioned in column 5 of the item; and
               (e)   for the purpose mentioned in column 6 of the item; and
               (f)   in accordance with the limitations (if any) mentioned in italics in column 6 of the item.
Part 4Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Additional conditions for the operation of ship stations Class B non assigned
4.1Â Â Â Â Â Â Â Â Â Â Application of Part 4
        (1)  For paragraph 107 (1) (f) of the Act, the operation, under a licence, of a ship station Class B non assigned is subject to the conditions in this Part.
        (2)  The conditions in this Part are additional to the conditions in Part 2.
4.2Â Â Â Â Â Â Â Â Â Â Permitted communications
               A licensee must operate a ship station Class B non assigned only:
               (a)   for any of the following operations or activities:
                         (i)   distress, urgency, safety and calling;
                        (ii)   public correspondence;
                        (iii)   commercial operations;
                       (iv)   non-commercial operations;
                        (v)   port operations;
                       (vi)   professional fishing operations;
                       (vii)   radiodetermination;
                      (viii)   on-board radiotelephony; and
              (b)   in accordance with the limitations in this Part about the operation or activity.
4.3          Distress, urgency, safety and calling — MF and HF communications
        (1)  If a licensee operates a ship station Class B non assigned on an MF or HF maritime frequency band for distress, urgency, safety and calling, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item (other than item 101 or 102) in Part 1 of Schedule 3; and
              (b)   using a transmitter output power not more than the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 5 of the item; and
              (d)   with a facility mentioned in column 6 of the item; and
               (e)   for a purpose mentioned in column 7 of the item; and
               (f)   in accordance with the limitations (if any) mentioned in italics in column 7 of the item.
        (2)  If a limitation mentioned in Part 1 of Schedule 3 states that this subsection applies, the carrier frequency must not be used as a calling frequency after 31 December 2003.
Note The carrier frequencies 12359 kHz and 16537 kHz may be used as calling frequencies before or after 31 December 2003, instead of a frequency to which subsection (2) relates.
4.4          Distress, urgency, safety and calling — VHF and UHF communications
               If a licensee operates a ship station Class B non assigned on a VHF or UHF maritime frequency band for distress, urgency, safety and calling, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 2 of Schedule 3; and
              (b)   using a transmitter output power not more than the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   with a facility mentioned in column 5 of the item; and
               (e)   for a purpose mentioned in column 6 of the item; and
               (f)   in accordance with the limitations (if any) mentioned in italics in column 6 of the item.
4.5Â Â Â Â Â Â Â Â Â Â Public correspondence by radiotelephony
               Subject to section 4.6, if a licensee operates a ship station Class B non assigned for radiotelephony to transmit public correspondence, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 3 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 4 of the item; and
               (c)   to communicate with a station mentioned in column 5 of the item; and
              (d)   with a facility mentioned in column 6 of the item; and
               (e)   in accordance with the requirements (if any) mentioned in italics in column 6 of the item.
4.6Â Â Â Â Â Â Â Â Â Â Public correspondence by radiotelegraphy using TOR and NBDP
               If a licensee operates a ship station Class B non assigned to transmit public correspondence in circumstances to which section 4.5 does not apply, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 4 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a major coast station for the purpose of NBDP or TOR.
4.7Â Â Â Â Â Â Â Â Â Â Commercial operations
               If a licensee operates a ship station Class B non assigned for radiotelephony for commercial operations, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 5 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   for a purpose mentioned in column 5 of the item; and
               (e)   in accordance with the limitations (if any) mentioned in italics in column 5 of the item.
4.8Â Â Â Â Â Â Â Â Â Â Non-commercial operations
               If a licensee operates a ship station Class B non assigned for radiotelephony for non-commercial operations, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 6 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   for a purpose mentioned in column 5 of the item; and
               (e)   in accordance with the requirements (if any) mentioned in italics in column 5 of the item.
4.9Â Â Â Â Â Â Â Â Â Â Port operations
               If a licensee operates a ship station Class B non assigned for radiotelephony for port operations, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 7 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   for a purpose mentioned in column 5 of the item.
4.10Â Â Â Â Â Â Â Professional fishing operations
               If a licensee operates a ship station Class B non assigned for radiotelephony for professional fishing operations, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 8 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 5 of the item; and
              (d)   for a purpose mentioned in column 6 of the item.
4.11Â Â Â Â Â Â Â Radiodetermination
               If a licensee operates a ship station Class B non assigned to transmit radiodetermination, the licensee must operate the station:
               (a)   on a frequency in a frequency band mentioned in column 2 of an item (other than item 901) in Part 9 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   for a purpose mentioned in column 4 of the item.
4.12Â Â Â Â Â Â Â On-board radiotelephony
               If the licensee operates a ship station Class B non assigned for on-board radiotelephony, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 10 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   for a purpose mentioned in column 4 of the item.
4.13       Automatic Identification System (AIS) — ship station Class B non assigned
               If the licensee operates a ship station Class B non assigned for Automatic Identification System (AIS) purposes, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 11 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   for a purpose mentioned in column 4 of the item.
Part 5Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Additional conditions for the operation of ship stations Class C assigned
5.1Â Â Â Â Â Â Â Â Â Â Application of Part 5
        (1)  For paragraph 107 (1) (f) of the Act, the operation, under a licence, of a ship station Class C assigned is subject to the conditions in this Part.
        (2)  The conditions in this Part are additional to the conditions in Part 2.
5.2Â Â Â Â Â Â Â Â Â Â Maintaining watch
               If a licensee operates a ship station Class C assigned on a type of ship mentioned in column 2 of an item in Schedule 4, the licensee must operate the station to maintain a listening watch in accordance with the requirements in columns 3 and 4 of the item.
5.3Â Â Â Â Â Â Â Â Â Â Response to distress, urgency and safety messages and record keeping
        (1)  This section applies if a ship station Class C assigned:
               (a)   receives a distress, urgency or safety message from another station; and
              (b)   does not immediately receive an indication that the message has been acknowledged.
        (2)  The licensee of the station must ensure, by the quickest and most effective means available, that:
               (a)   an acknowledgment of the message is directed to the other station; and
              (b)   the message is forwarded to:
                         (i)   the station or authority named in the message; or
                        (ii)   if the message does not name a station or authority — an appropriate station or authority.
        (3)  The licensee must keep, for at least 2 years, a record of the following information relating to a message mentioned in subsection (1):
               (a)   the date and time of reception of the message;
              (b)   the identity of the other station;
               (c)   the frequency on which the message was received;
              (d)   the information in the message;
               (e)   the action taken by the licensee to comply with subsection (2).
Part 6Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Additional conditions for operation of ship stations Class C non assigned
6.1Â Â Â Â Â Â Â Â Â Â Application of Part 6
        (1)  For paragraph 107 (1) (f) of the Act, the operation, under a licence, of a ship station Class C non assigned is subject to the conditions in this Part.
        (2)  The conditions in this Part are additional to the conditions in Part 2.
6.2Â Â Â Â Â Â Â Â Â Â Permitted communications
               A licensee must operate a ship station Class C non assigned only:
               (a)   for any of the following operations or activities:
                         (i)   commercial operations by radiotelegraphy using morse;
                        (ii)   non-commercial operations;
                        (iii)   distress, urgency, safety and calling;
                       (iv)   public correspondence;
                        (v)   port operations;
                       (vi)   professional fishing operations;
                       (vii)   radiodetermination communications;
                      (viii)   on-board radiotelephony; and
              (b)   in accordance with the limitations in this Part about the operation or activity.
6.3Â Â Â Â Â Â Â Â Â Â Commercial operations by radiotelegraphy using morse
               If a licensee operates a ship station Class C non assigned for radiotelephony using morse for commercial operations, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 1 of Schedule 5; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   for a purpose mentioned in column 5 of the item; and
               (e)   in accordance with the limitations (if any) mentioned in italics in column 5 of the item.
6.4Â Â Â Â Â Â Â Â Â Â Non-commercial operations
               If a licensee operates a ship station Class C non assigned for radiotelephony for non-commercial operations, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 2 of Schedule 5; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   for a purpose mentioned in column 5 of the item.
6.5          Distress, urgency, safety and calling — MF and HF communications
        (1)  If a licensee operates a ship station Class C non assigned on an MF or HF maritime frequency band for distress, urgency, safety and calling, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 1 of Schedule 3; and
              (b)   using a transmitter output power not more than the power mentioned in column 4 of the item; and
               (c)   to communicate with a station mentioned in column 5 of the item; and
              (d)   with a facility mentioned in column 6 of the item; and
               (e)   for a purpose mentioned in column 7 of the item; and
               (f)   in accordance with the limitations (if any) mentioned in italics in column 7 of the item.
        (2)  If a limitation mentioned in Part 1 of Schedule 3 states that this subsection applies, the carrier frequency must not be used as a calling frequency after 31 December 2003.
Note The carrier frequencies 12359 kHz and 16537 kHz may be used as calling frequencies before or after 31 December 2003, instead of a frequency to which subsection (2) relates.
6.6          Distress, urgency, safety and calling — VHF and UHF communications
               If a licensee operates a ship station Class C non assigned on a VHF or UHF maritime frequency band for distress, urgency, safety and calling, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 2 of Schedule 3; and
              (b)   using a transmitter output power not more than the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   with a facility mentioned in column 5 of the item; and
               (e)   for a purpose mentioned in column 6 of the item; and
               (f)   in accordance with the limitations (if any) mentioned in italics in column 6 of the item.
6.7Â Â Â Â Â Â Â Â Â Â Public correspondence by radiotelephony
               Subject to section 6.8, if a licensee operates a ship station Class C non assigned for radiotelephony to transmit public correspondence, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 3 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 4 of the item; and
               (c)   to communicate with a station mentioned in column 5 of the item; and
              (d)   with a facility mentioned in column 6 of the item; and
               (e)   in accordance with the requirements (if any) mentioned in italics in column 6 of the item.
6.8Â Â Â Â Â Â Â Â Â Â Public correspondence by radiotelegraphy using TOR and NBDP
               If a licensee operates a ship station Class C non assigned to transmit public correspondence in circumstances to which section 6.7 does not apply, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 4 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a major coast station for the purpose of NBDP or TOR.
6.9Â Â Â Â Â Â Â Â Â Â Port operations
               If a licensee operates a ship station Class C non assigned for radiotelephony for port operations, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 7 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   to communicate with a station mentioned in column 4 of the item; and
              (d)   for a purpose mentioned in column 5 of the item.
6.10Â Â Â Â Â Â Â Professional fishing operations
               If a licensee operates a ship station Class C non assigned for radiotelephony for professional fishing operations, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 8 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 4 of the item; and
               (c)   to communicate with a station mentioned in column 5 of the item; and
              (d)   for a purpose mentioned in column 6 of the item.
6.11Â Â Â Â Â Â Â Radiodetermination
               If a licensee operates a ship station Class C non assigned to transmit radiodetermination communications, the licensee must operate the station:
               (a)   on a frequency in a frequency band mentioned in column 2 of an item (other than item 901) in Part 9 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 4 of the item; and
               (c)   for a purpose mentioned in column 4 of the item.
6.12Â Â Â Â Â Â Â On-board radiotelephony
               If the licensee operates a ship station Class C non assigned for on-board radiotelephony, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 10 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 4 of the item; and
               (c)   for a purpose mentioned in column 4 of the item.
6.12A     Automatic Identification System (AIS) — ship station Class C non assigned
               If the licensee operates a ship station Class C non assigned for Automatic Identification System (AIS) purposes, the licensee must operate the station:
               (a)   on a frequency mentioned in column 2 of an item in Part 11 of Schedule 3; and
              (b)   using a transmitter output power not exceeding the power mentioned in column 3 of the item; and
               (c)   for a purpose mentioned in column 4 of the item.
6.13Â Â Â Â Â Â Â Maintaining watch
               If a licensee operates a ship station Class C non assigned on a type of ship mentioned in column 2 of an item in Schedule 4, the licensee must operate the station to maintain a listening watch in accordance with the requirements in columns 3 and 4 of the item.

        (1)  This section applies if a ship station Class C non assigned:
