Aboriginal and Torres Strait Islander Heritage Protection Act 1984

 

 

DECLARATION UNDER SECTION 10

 

 

I, ROBERT EDWARD TICKNER, Minister of State for Aboriginal and Torres Strait Islander Affairs, having received and considered a report under subsection 10 (4) of the Aboriginal and Torres Strait Islander Heritage Protection Act 1984 from the Hon. J. H. Wootten, A.C., Q.C., and the representations attached to the report, and being satisfied that:

(a)     the area in the Northern Territory described in Schedule 1 (which contains the site complexes known as Atnyere Arrkelthe, Atniltye and Urewe Aterle) is a significant Aboriginal area; and

            (b)     the area is under threat of injury or desecration:

declare under subsection 10 (1) of the Act that, for the protection and preservation of the area from injury or desecration, acts of the kind specified in Schedule 2 must not be carried out in the area during the period of 20 years from the date on which this declaration is published in the Gazette.

 

 

SCHEDULE 1

 

DESCRIPTION OF AREA

 

 

The area encompassing all aspects of the physical landscape contained in the bed and banks of the Todd River and extending to the tops of the hills immediately adjacent to the western and eastern banks of the Todd River between the co-ordinates E.387, 378, N.7, 388, 075 and the co-ordinates E.386, 820. N.7, 387, 240, Australian Map Grid Zone 53K, and between the co-ordinates E.386, 820, N.7, 387, 240 and the co-ordinates E.385, 903,

N.7, 386, 050, Australian Map Grid Zone 53K.

 

 

SCHEDULE 2

 

PROHIBITED ACTS

 

1.         Damaging or defacing any rock in the area described in Schedule 1.

 

2.         Bulldozing, grading, drilling or excavating, or any other act that will, or is likely to, injure or desecrate, the area or part of the area.

 

3.         Any act done for the purpose of constructing a dam in the area or any part of the area.

 

4.         Killing, cutting down, damaging, defacing or removing any tree in the area.

 

The prohibited acts referred to in paragraphs 1 to 4 do not include:

 

(a)        the depasturing of cattle in the area described in Schedule 1 or passing through it in the normal course of the business of operating a pastoral lease held over the area; or

(b)        any act done by the Northern Territory Power and Water Authority for the purpose of removing equipment from the area, or for the purpose of restoring, in accordance with the wishes of custodians, any damage already done to the area.
