These Regulations amend the Family Law Regulations 1984 to ensure references to provisions relating to child support are consistent with changes made to the Child Support (Assessment) Act 1989 and the Child Support (Registration and Collection) Act 1988 by the Families, Community Services and Indigenous Affairs Legislation Amendment (Child Support Reform Consolidation and Other Measures) Act 2007.

I, QUENTIN BRYCE, Governor‑General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Family Law Act 1975.

1              Name of Regulations

                These Regulations are the Family Law Amendment Regulations 2008 (No. 3).

2              Commencement

                These Regulations commence on the day after they are registered.

3              Amendment of Family Law Regulations 1984

                Schedule 1 amends the Family Law Regulations 1984.

section 25A of the Child Support (Registration and Collection) Act 1988

[2]           Regulation 24A, definition of registered maintenance liability

omit

subregulation 11 (1) or (2) or paragraph 11 (3) (a) of the Child Support (Registration and Collection) (Overseas‑related Maintenance Obligations) Regulations 2000 that is registered under those Regulations

insert

section 18A of the Child Support (Registration and Collection) Act 1988

Child Support (Assessment) (Overseas‑related Maintenance Obligations) Regulations 2000, for administrative assessment of child support (within the meaning of that Act)
