This Determination allows employees to make contributions to an alternative superannuation arrangement if they have ceased membership of the Public Sector Superannuation Scheme (PSS) in accordance with the Choice of Fund arrangements for PSS members that are due to commence on 1 July 2008 and allows alternative superannuation arrangements to continue for certain employees whose employment arrangements or employer status have changed.

Superannuation Benefits (Prescribed Requirements) Amendment Determination 2008 (No. 1)1

 

 

I, NICK SHERRY, Minister for Superannuation and Corporate Law, acting for and on behalf of the Minister for Finance and Deregulation, make the following Determination under section 6 of the Superannuation Benefits (Supervisory Mechanisms) Act 1990.

1              Name of Determination

                This Determination is the Superannuation Benefits (Prescribed Requirements) Amendment Determination 2008 (No. 1).

2              Commencement

                This Determination commences on 1 July 2007.

3              Amendment of Superannuation Benefits (Prescribed Requirements) Determination 2005

                Schedule 1 amends the Superannuation Benefits (Prescribed Requirements) Determination 2005.

(section 3)

[1]           Section 3, definition of “relevant employee”

omit paragraph (c), substitute

(c)     is appointed for a fixed term which commenced on or after 1 July 2005; or

(d)     has ceased to be a member of the PSS under section 6B of the 1990 Act; or

(e)     was employed before 1 July 2005, and for whom an employer was permitted to make contributions to a superannuation arrangement established under a Prior Determination.
