Declarations/Superannuation as made
This Declaration amends the Superannuation (PSSAP) Membership Eligibility (Inclusion) Declaration 2005 to continue the superannuation arrangements for those Calvary employees who would otherwise cease to be PSSAP members because of the Superannuation (PSSAP) Approved Authority Exclusion Amendment Declaration 2008.

I, NICK SHERRY, Minister for Superannuation and Corporate Law, acting for and on behalf of the Minister for Finance and Deregulation, make the following Declaration under paragraph 13 (1) (b) of the Superannuation Act 2005.

1              Name of Declaration

                This Declaration is the Superannuation (PSSAP) Membership Eligibility (Inclusion) Amendment Declaration 2008.

2              Commencement

This Declaration comes into effect immediately after the Superannuation (PSSAP) Approved Authority Exclusion Amendment Declaration 2008 commences.

3              Amendments to the Superannuation (PSSAP) Membership Eligibility (Inclusion) Declaration 2005

(a)    In paragraph 3 of the Superannuation (PSSAP) Membership Eligibility (Inclusion) Declaration 2005, insert:

       

                        Calvary Commencement Date       means the date the Superannuation (PSSAP) Membership Eligibility (Inclusion) Amendment Declaration 2008 commenced.

 

(b)    After item [10] of Schedule 1 of the Superannuation (PSSAP)             Membership Eligibility (Inclusion) Declaration 2005, insert:

 

[11]                  A person who:

 

(a)        immediately before the Calvary Commencement Date, was employed by Calvary Health Care ACT Limited; and

 

(b)        immediately before the Calvary Commencement Date, was an ordinary employer-sponsored member in respect of that employment,

 

for so long as that person continues to be employed by that employer on and after the Calvary Commencement Date.
