Direction under section 32, Financial Management and Accountability Act 1997 - Adjustments of Appropriations on Change of Agency Functions (No. 9 of 2007-2008)

This Direction provides that part of the departmental items, being an amount of $5,277,986.00 in departmental outputs under Appropriation Act (No. 1) 2006-2007 provided to the Department of Employment and Workplace Relations be transferred to the Workplace Authority.

General Comments: This Direction was made under section 32 of the Financial Management and Accountability Act 1997. Despite the repeal and substitution of the section made by Schedule 1, item 9 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166, section 32 of the Financial Management and Accountability Act 1997 (as in force immediately before the commencement of that item) continues to apply after that commencement in relation to a change in function that occurred before that commencement (see Schedule 1, item 17 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166).

DIRECTION UNDER SECTION 32, FINANCIAL MANAGEMENT AND ACCOUNTABILITY ACT 1997

Context:           

On 28 May 2007, a decision was made to transfer the Office of the Employment Advocate function from the Department of Employment and Workplace Relations to the Workplace Authority. 

I, Tim Youngberry, Division Manager, Financial Reporting and Cash Management Division, Department of Finance and Deregulation, sub-delegate of the Minister for Finance and Deregulation under the Financial Management and Accountability Act 1997 (‘the FMA Act’), issue the following direction under section 32 of the FMA Act:

That part of the appropriation item listed in column 1 of the following table (being the amount listed in column 4) be transferred from the 'old agency' listed in column 2 to the 'new agency' listed in column 3.
