1 Name of Determination
This Determination is the FMA Act Determination 2008/01 — Section 32 (Transfer of Functions from the Department of Infrastructure, Transport, Regional Development and Local Government to the Attorney‑General’s Department).
Note 1 This Determination has been made by a delegate of the Secretary of the Department of Finance and Deregulation. The Secretary is a delegate of the Minister for Finance and Deregulation: see sections 53 and 62 of the FMA Act.
Note 2 The Appropriation Acts, as made, refer to the names of particular Departments. However, some of those references have changed due to the reorganisation of government functions. The changes are:
(a) the Transport and Regional Services portfolio was renamed as the Infrastructure, Transport, Regional Development and Local Government portfolio; and
(b) the Department of Transport and Regional Services was renamed as the Department of Infrastructure, Transport, Regional Development and Local Government.
2 Commencement
This Determination commences on 24 January 2008.
Note Under subsection 32 (8) of the FMA Act, a Determination may be expressed to take effect before its making and registration under the Legislative Instruments Act 2003.
3 Amendment of Appropriation Act (No. 1) 2007–2008
(1) Schedule 1 amends the Appropriation Act (No. 1) 2007–2008.
(2) An amount of $69,213,403.20 of the administered item for Outcome 2 for the Department of Infrastructure, Transport, Regional Development and Local Government is transferred to new Outcome 3 of the administered item for the Attorney‑General’s Department.
Note The amount transferred relates to the following functions:
(a) $4,000,000.00 associated with the natural disaster relief;
(b) $65,213,403.20 associated with services to Territories.
4 Amendment of Appropriation Act (No. 2) 2007–2008
(1) Schedule 2 amends the Appropriation Act (No. 2) 2007–2008.
(2) An amount of $133,870,113.68 of the States, ACT, NT and local government item for Outcome 2 for the Department of Infrastructure, Transport, Regional Development and Local Government is transferred to new Outcome 3 of the administered item for the Attorney‑General’s Department.
Note The amount transferred relates to the following functions:
(a) $115,783,729.00 associated with the natural disaster relief;
(b) $18,086,384.68 associated with services to Territories.
5 Amendment of Appropriation Act (No. 2) 2007–2008
(1) Schedule 3 amends the Appropriation Act (No. 2) 2007–2008.
(2) An amount of $6,155,311.82 of the administered assets and liabilities item for the Department of Infrastructure, Transport, Regional Development and Local Government is transferred to the Attorney‑General’s Department.
Note The amount transferred relates to the following functions:
(a) $5,000,000.00 associated with the natural disaster relief;
(b) $1,155,311.82 associated with services to Territories.
6 Amendment of Appropriation Act (No. 2) 2006–2007
(1) Schedule 4 amends the Appropriation Act (No. 2) 2006–2007.
(2) An amount of $69,542,998.95 of the administered assets and liabilities item for the Department of Infrastructure, Transport, Regional Development and Local Government is transferred to the Attorney‑General’s Department.
Note The amount transferred relates to the following functions:
(a) $66,586,998.95 associated with the natural disaster relief;
(b) $2,956,000.00 associated with services to Territories.
7 Amendment of Appropriation Act (No. 4) 2004–2005
(1) Schedule 5 amends the Appropriation Act (No. 4) 2004–2005.
(2) An amount of $66,613,511.82 of the administered assets and liabilities item for the services to Territories function for the Department of Infrastructure, Transport, Regional Development and Local Government is transferred to the Attorney‑General’s Department.
8 Amendment of Appropriation Act (No. 2) 1999–2000
(1) Schedule 6 amends the Appropriation Act (No. 2) 1999–2000.
(2) An amount of $346,860.68 of the administered assets and liabilities item for the services to Territories function for the Department of Infrastructure, Transport, Regional Development and Local Government is transferred to the Attorney‑General’s Department.
