This Direction provides that departmental items totalling $1,500,000 provided to the Attorney-General’s Department in Appropriation Act (No. 1) 2007-2008 be transferred to the Australian Commission for Law Enforcement Integrity.

General Comments: This Direction was made under section 32 of the Financial Management and Accountability Act 1997. Despite the repeal and substitution of the section made by Schedule 1, item 9 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166, section 32 of the Financial Management and Accountability Act 1997 (as in force immediately before the commencement of that item) continues to apply after that commencement in relation to a change in function that occurred before that commencement (see Schedule 1, item 17 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166).

DIRECTION UNDER SECTION 32, FINANCIAL MANAGEMENT AND ACCOUNTABILITY ACT 1997

Context:

The Law Enforcement Integrity Commissioner Act 2006 established the office of the Integrity Commissioner.  Regulations made under the Financial Management and Accountability Act 1997 prescribed the Australian Commission for Law Enforcement Integrity (ACLEI) as a prescribed agency.  Amounts were initially appropriated to the Attorney-General's Department as part of its departmental item in relation to the functions of ACLEI. 

I, Brett Kaufmann, Acting Division Manager, Financial Reporting and Cash Management Division, Department of Finance and Administration, sub-delegate of the Minister for Finance and Administration under the Financial Management and Accountability Act 1997 (‘the FMA Act’), issue the following direction under section 32 of the FMA Act:

That part of the appropriation item listed in column 1 of the following table (being the amount listed in column 4) be transferred from the 'old agency' listed in column 2 to the 'new agency' listed in column 3.
