This Direction provides that departmental appropriation in the amount of $8,839,000 provided to the Office of Film and Literature Classification (OFLC) in Appropriation Act (No.1) 2007-2008 be transferred to the Attorney-General’s Department (AGD). The instrument also directs that administered appropriation for Payments to States, ACT, NT and local government in the amount of $833,000 provided to OFLC in Appropriation Act (No. 2) 2007-2008 be transferred to AGD.

General Comments: This Direction was made under section 32 of the Financial Management and Accountability Act 1997. Despite the repeal and substitution of the section made by Schedule 1, item 9 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166, section 32 of the Financial Management and Accountability Act 1997 (as in force immediately before the commencement of that item) continues to apply after that commencement in relation to a change in function that occurred before that commencement (see Schedule 1, item 17 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166).

DIRECTION UNDER SECTION 32, FINANCIAL MANAGEMENT AND ACCOUNTABILITY ACT 1997

Context:           

On 23 February 2006, the Attorney-General announced that the policy and administrative functions previously held by the Office of Film and Literature Classification (OFLC) would be folded into the Attorney-General’s Department (AGD). On 7 July 2006, a preliminary section 32 direction was issued to transfer appropriation originally appropriated to the OFLC to AGD. This direction completes the transfer of functions from OFLC to AGD.

I, Brett Kaufmann, Acting Division Manager, Financial Reporting and Cash Management Division, Department of Finance and Administration, sub-delegate of the Minister for Finance and Administration under the Financial Management and Accountability Act 1997 (‘the FMA Act’), issue the following direction under section 32 of the FMA Act:

That the appropriation items listed in column 1 of the following table in the amounts listed in column 4 be transferred from the 'old agency' listed in column 2 to the 'new agency' listed in column 3.
