This Direction provides that departmental items totalling $1,219,315 provided to the Department of Employment and Workplace Relations in Appropriation Act (No. 1) 2007-2008 be transferred to the Office of the Workplace Ombudsman.

General Comments: This Direction was made under section 32 of the Financial Management and Accountability Act 1997. Despite the repeal and substitution of the section made by Schedule 1, item 9 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166, section 32 of the Financial Management and Accountability Act 1997 (as in force immediately before the commencement of that item) continues to apply after that commencement in relation to a change in function that occurred before that commencement (see Schedule 1, item 17 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166).

DIRECTION UNDER SECTION 32, FINANCIAL MANAGEMENT AND ACCOUNTABILITY ACT 1997

Context:           

The Office of the Workplace Ombudsman was established on 1 July 2007, following the passing of the Workplace Relations Amendment (A Stronger Safety Net) Act 2007.  Subsequently, the compliance functions relating to the Workplace Relations Act 1996 that were being undertaken by the Department of Employment and Workplace Relations were transferred to the Office of the Workplace Ombudsman.

I, Brett Kaufmann, Acting Division Manager, Financial Reporting and Cash Management Division, Department of Finance and Administration, sub-delegate of the Minister for Finance and Administration under the Financial Management and Accountability Act 1997 (‘the FMA Act’), issue the following direction under section 32 of the FMA Act:

That the appropriation items listed in column 1 of the following table in the amounts listed in column 4 be transferred from the 'old agency' listed in column 2 to the 'new agency' listed in column 3.
