Direction under section 32, Financial Management and Accountability Act 1997 – Adjustments of Appropriations on Change of Agency Functions (No. 16 of 2006-2007)

This Direction provides that departmental items totalling $341,256.94 provided to the Department of the Prime Minister and Cabinet (PM&C) in Appropriation Act (No. 1) 2005-2006 be transferred to the Department of the Environment and Water Resources (DEW) and that departmental items totalling $7,525.54 provided to PM&C in Appropriation Act (No. 1) 2006-2007 be transferred to the Department of Environment and Water Resources (DEW).

General Comments: This Direction was made under section 32 of the Financial Management and Accountability Act 1997. Despite the repeal and substitution of the section made by Schedule 1, item 9 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166, section 32 of the Financial Management and Accountability Act 1997 (as in force immediately before the commencement of that item) continues to apply after that commencement in relation to a change in function that occurred before that commencement (see Schedule 1, item 17 of the Financial Framework Legislation Amendment Act (No. 1) 2007 (Act No. 166 of 2007) C2007A00166).

DIRECTION UNDER SECTION 32, FINANCIAL MANAGEMENT AND ACCOUNTABILITY ACT 1997

Context:           

On 30 January 2007, changes to the Administrative Arrangements Order transferred the Office of Water Resources from the Department of the Prime Minister and Cabinet to the Department of the Environment and Water Resources.

I, Brett Kaufmann, Acting Division Manager, Financial Reporting and Cash Management Division, Department of Finance and Administration, sub-delegate of the Minister for Finance and Administration under the Financial Management and Accountability Act 1997 (‘the FMA Act’), issue the following direction under section 32 of the FMA Act:

That the appropriation items listed in column 1 of the following table in the amounts listed in column 4 be transferred from the 'old agency' listed in column 2 to the 'new agency' listed in column 3.
