1              Name of Determination

                This Determination is the Do Not Call Register (Administration and Operation) Determination 2007.

2              Commencement

                This Determination commences on 3 May 2007.

3              Definitions

                In this Determination:

Act means the Do Not Call Register Act 2006.

Note   Several other words and expressions used in this Determination have the meanings given by section 4 of the Act. These include:

·      ACMA

·      contracted service provider

·      Do Not Call Register

·      nominee

·      relevant telephone account‑holder.

4              Applications for registration

Manner in which applications may be made

         (1)   Subject to subsections (2) and (12), an application to register a telephone number on the Do Not Call Register may be made:

                (a)    by telephone; or

               (b)    via the internet; or

                (c)    in writing; or

               (d)    in any other way approved by ACMA.

         (2)   A nominee of a relevant telephone account‑holder may apply only:

                (a)    in writing; or

               (b)    in any other way approved by ACMA.

Application by telephone

         (3)   A relevant telephone account‑holder who wishes to apply by telephone, must:

                (a)    call a telephone number specified on:

                          (i)    if the Do Not Call Register is kept by ACMA — ACMA’s website; or

                         (ii)    if the Do Not Call Register is kept by the contracted service provider — the website of the contracted service provider;

                        from the telephone number sought to be registered; and

               (b)    provide the telephone number to be registered, including the area code, if any; and

                (c)    state that he or she is the relevant telephone account‑holder for the telephone number sought to be registered; and

               (d)    state that the telephone number sought to be registered is used or maintained exclusively or primarily for private or domestic purposes; and

                (e)    state that the telephone number sought to be registered is not used or maintained exclusively for transmitting or receiving faxes; and

                (f)    state that he or she would like the telephone number registered on the Do Not Call Register; and

                (g)    state that he or she understands that confirmation of his or her intention to register the telephone number on the Do Not Call Register may be obtained by return call to the telephone number sought to be registered.

Application via the internet

         (4)   A relevant telephone account‑holder who wishes to apply via the internet must submit an application using the online application form on:

                (a)    if the Do Not Call Register is kept by ACMA — ACMA’s website; or

               (b)    if the Do Not Call Register is kept by the contracted service provider — the website of the contracted service provider.

         (5)   In the application, the relevant telephone account‑holder must:

                (a)    enter his or her full name; and

               (b)    enter the telephone number sought to be registered, including the area code, if any; and

                (c)    state that he or she is the relevant telephone account‑holder for the telephone number sought to be registered; and

               (d)    state that the telephone number sought to be registered is used or maintained exclusively or primarily for private or domestic purposes; and

                (e)    state that the telephone number sought to be registered is not used or maintained exclusively for transmitting or receiving faxes; and

                (f)    state that he or she would like the telephone number registered on the Do Not Call Register; and

                (g)    provide an email address, which may be used for:

                          (i)    seeking confirmation of his or her intention to register the telephone number on the Do Not Call Register; and

                         (ii)    general correspondence; and

                         (iii)    investigation of any possible abuse of the online registration process; and

                (h)    state that the registration of the telephone number on the Do Not Call Register will not breach any of the conditions mentioned in subsection (6).

         (6)   A relevant telephone account‑holder who provides an e‑mail address under paragraph 5 (g) above must not:

                (a)    register more than 3 telephone numbers at any one time, using that e‑mail address; or

               (b)    register more than 10 telephone numbers within a period of 3 years, using that e‑mail address.

Application in writing

         (7)   A relevant telephone account‑holder, or a nominee of a relevant telephone account‑holder, who wishes to apply in writing must send an application to:

                (a)    if the Do Not Call Register is kept by ACMA — a postal address or fax number specified on ACMA’s website; or

               (b)    if the Do Not Call Register is kept by the contracted service provider — a postal address or fax number specified on the website of the contracted service provider. 

         (8)   In the application, the relevant telephone account‑holder or nominee must:

                (a)    provide his or her name and the telephone number sought to be registered, including the area code, if any; and

               (b)    state that he or she is the relevant telephone account‑holder, or a nominee of the relevant telephone account‑holder, for the telephone number sought to be registered; and

                (c)    state that the telephone number sought to be registered is used or maintained exclusively or primarily for private or domestic purposes; and

               (d)    state that the telephone number sought to be registered is not used or maintained exclusively for transmitting or receiving faxes; and

                (e)    state that he or she would like the telephone number registered on the Do Not Call Register; and

                (f)    provide a copy of a bill for the telephone account associated with the telephone number sought to be registered.

         (9)   If the applicant is a relevant telephone account‑holder, the applicant must also provide his or her contact details for correspondence.

       (10)   If the applicant is a nominee of a relevant telephone account‑holder, the applicant must also provide:

                (a)    written evidence of the nomination; and

               (b)    the name of the relevant telephone account‑holder; and

                (c)    his or her contact details and the contact details of the relevant telephone account‑holder, for correspondence.

Entry of details on the Do Not Call Register

       (11)   Following an application under this section, ACMA or the contracted service provider must enter the telephone number sought to be registered, including the area code, if any, on the Do Not Call Register.

Applications before 14 May 2007

       (12)   Before 14 May 2007 an application may be made only:

                (a)    via the internet; or

               (b)    in writing; or

                (c)    in any other way approved by ACMA.

Note 1   ACMA or the contracted service provider is not required to obtain confirmation of intention to register a telephone number, before registering that telephone number on the Do Not Call Register.

Note 2   ACMA and the contracted service provider (if any) are both bound by the Privacy Act 1988.

Note 3   No fee is payable for registration.

Note 4   Giving false or misleading information is a serious offence under section 137.1 of the Criminal Code.

5              Applications for correction of entries made on the Do Not Call Register

Manner in which applications may be made

         (1)   A relevant telephone account‑holder or a nominee of a relevant telephone account‑holder may apply to correct an entry relating to a telephone number of the relevant telephone account‑holder on the Do Not Call Register.

         (2)   Subject to subsections (3) and (9), an application may be made:

                (a)    by telephone; or

               (b)    in writing; or

                (c)    in any other way approved by ACMA.

         (3)   A nominee of a relevant telephone account‑holder may apply only:

                (a)    in writing; or

               (b)    in any other way approved by ACMA.

Application by telephone

         (4)   A relevant telephone account‑holder who wishes to apply by telephone must:

                (a)    call a telephone number specified on:

                          (i)    if the Do Not Call Register is kept by ACMA — ACMA’s website; or

                         (ii)    if the Do Not Call Register is kept by the contracted service provider — the website of the contracted service provider;

                        from the telephone number sought to be registered following the correction; and

               (b)    state that he or she is the relevant telephone account‑holder for the telephone number sought to be registered; and

                (c)    provide the details, if known, of the telephone number, including area code, if any, incorrectly registered on the Do Not Call Register; and

               (d)    provide the details of the telephone number that should have been entered on the Do Not Call Register, including the area code, if any; and

                (e)    state that the telephone number sought to be registered is used or maintained exclusively or primarily for private or domestic purposes; and

                (f)    state that the telephone number sought to be registered is not used or maintained exclusively for transmitting or receiving faxes; and

                (g)    state that he or she would like the Do Not Call Register corrected; and

                (h)    state that he or she understands that confirmation of his or her intention to register the telephone number that should have been registered on the Do Not Call Register may be obtained by return call to the telephone number sought to be registered.

Application in writing

         (5)   A relevant telephone account‑holder, or a nominee of a relevant telephone account‑holder, who wishes to apply in writing must send an application to:

                (a)    if the Do Not Call Register is kept by ACMA — a postal address or fax number specified on ACMA’s website; or

               (b)    if the Do Not Call Register is kept by the contracted service provider — a postal address or fax number specified on the website of the contracted service provider. 

         (6)   In the application, the relevant telephone account‑holder or nominee must:

                (a)    state that he or she is the relevant telephone account‑holder, or a nominee of the relevant telephone account‑holder, for the telephone number sought to be registered following the correction; and

               (b)    provide the details of any telephone number incorrectly registered on the Do Not Call Register, if known, including the area code, if any; and

                (c)    provide the details of the telephone number that should have been entered on the Do Not Call Register, including the area code, if any; and

               (d)    state that the telephone number sought to be registered is used or maintained exclusively or primarily for private or domestic purposes; and

                (e)    state that the telephone number sought to be registered is not used or maintained exclusively for transmitting or receiving faxes; and

                (f)    state that he or she would like the Do Not Call Register corrected; and

                (g)    provide a copy of a bill for the telephone account associated with the telephone number sought to be registered.

         (7)   If the applicant is a relevant telephone account‑holder, the applicant must also provide his or her contact details for correspondence.

         (8)   If the applicant is a nominee of a relevant telephone account‑holder, the applicant must also provide:

                (a)    written evidence of the nomination; and

               (b)    the name of the relevant telephone account‑holder; and

                (c)    his or her contact details and the contact details of the relevant telephone account‑holder, for correspondence.

Applications before 14 May 2007

         (9)   Before 14 May 2007 an application may only be made in a way approved by ACMA.

Note 1   ACMA or the contracted service provider is not required to obtain confirmation of intention to correct an entry, before correcting that entry on the Do Not Call Register.

Note 2   ACMA and the contracted service provider (if any) are both bound by the Privacy Act 1988.

Note 3   No fee is payable for correction of the Do Not Call Register.

Note 4   Giving false or misleading information is a serious offence, under section 137.1 of the Criminal Code.

6              Correction of the Do Not Call Register

         (1)   ACMA or the contracted service provider may check the correctness of an entry on the Do Not Call Register at any time, and must do so if it receives an application under section 5 in relation to that entry.

         (2)   If ACMA or the contracted service provider determines that an entry on the Do Not Call Register is incorrect, ACMA or the contracted service provider must:

                (a)    before any correction is made, inform the person identified by ACMA or the contracted service provider as the relevant telephone account‑holder for the telephone number associated with the entry that the entry is to be corrected; and

               (b)    correct the entry.

7              Removal of entries from the Do Not Call Register

Manner in which applications may be made

         (1)   A relevant telephone account‑holder, or a nominee of a relevant telephone account‑holder, may apply to remove an entry for a telephone number of the relevant telephone account‑holder from the Do Not Call Register.

         (2)   Subject to subsections (3) and (10), an application to remove a telephone number from the Do Not Call Register may be made:

                (a)    by telephone; or

               (b)    in writing; or

                (c)    in any other way approved by ACMA.

         (3)   A nominee of a relevant telephone account‑holder may apply only:

                (a)    in writing; or

               (b)    in any other way approved by ACMA.

Application by telephone

         (4)   A relevant telephone account‑holder who wishes to apply by telephone must:

                (a)    call a telephone number specified on:

                          (i)    if the Do Not Call Register is kept by ACMA — ACMA’s website; or

                         (ii)    if the Do Not Call Register is kept by the contracted service provider — the website of the contracted service provider;

                        from the telephone number sought to be removed; and

               (b)    provide the telephone number sought to be removed, including the area code, if any; and

                (c)    state that he or she is the relevant telephone account‑holder for the telephone number sought to be removed; and

               (d)    state that he or she would like the telephone number removed from the Do Not Call Register; and

                (e)    state that he or she understands that confirmation of his or her intention to remove the telephone number from the Do Not Call Register may be obtained by return call to the telephone number sought to be removed.

Application in writing

         (5)   A relevant telephone account‑holder, or a nominee of a relevant telephone account‑holder, who wishes to apply in writing must send an application to:

                (a)    if the Do Not Call Register is kept by ACMA — a postal address or fax number specified on ACMA’s website; or

               (b)    if the Do Not Call Register is kept by the contracted service provider — a postal address or fax number specified on the website of the contracted service provider. 

         (6)   In the application, the relevant telephone account‑holder or nominee must:

                (a)    provide his or her name and the telephone number to be removed from the Do Not Call Register, including the area code, if any; and

               (b)    state that he or she is the relevant telephone account‑holder, or a nominee of a relevant telephone account‑holder, for the telephone number sought to be removed; and

                (c)    state that he or she would like the telephone number removed from the Do Not Call Register; and

               (d)    provide a copy of a bill for the telephone account associated with the telephone number.

         (7)   If the applicant is a relevant telephone account‑holder, the applicant must also provide his or her contact details for correspondence.

         (8)   If the applicant is a nominee of a relevant telephone account‑holder, the applicant must also provide:

                (a)    written evidence of the nomination; and

               (b)    the name of the relevant telephone account‑holder; and

                (c)    his or her contact details and the contact details of the relevant telephone account‑holder, for correspondence.

Removal of telephone number by ACMA or contracted service provider

         (9)   Following an application under this section, ACMA or the contracted service provider must remove the entry from the Do Not Call Register.

Applications before 14 May 2007

       (10)   Before 14 May 2007 an application may only be made in a way approved by ACMA.

Note 1   ACMA or the contracted service provider is not required to obtain confirmation of intention to remove a telephone number, before removing that telephone number from the Do Not Call Register.

Note 2   ACMA and the contracted service provider (if any) are both bound by the Privacy Act 1988.

Note 3   No fee is payable for removal of a telephone number from the Do Not Call Register.

Note 4   Giving false or misleading information is a serious offence, under section 137.1 of the Criminal Code.

8              Removal of ineligible telephone numbers from the Do Not Call Register

         (1)   ACMA must remove, or require the contracted service provider to remove, an entry from the Do Not Call Register if ACMA is satisfied that:

                (a)    the telephone number associated with that entry is not eligible to be entered on the Do Not Call Register; or

               (b)    the person who applied to register the telephone number associated with that entry was not eligible, under section 15 of the Act, to register the telephone number on the Do Not Call Register.

         (2)   Before removing an entry from the Do Not Call Register under subsection (1), ACMA or the contracted service provider must inform the person identified by ACMA or the contracted service provider as the relevant telephone account‑holder for the number associated with the entry that the entry is to be removed from the Do Not Call Register.

9              Accessing the Do Not Call Register to check whether a telephone number has been registered

Manner in which applications may be made

         (1)   A relevant telephone account‑holder, or a nominee of a relevant telephone account‑holder, may apply to access the Do Not Call Register to check whether a telephone number of the relevant telephone account‑holder has been registered.

         (2)   Subject to subsections (3) and (14), an application to access the Do Not Call Register to check whether a telephone number has been registered may be made:

                (a)    by telephone; or

               (b)    via the internet; or

                (c)    in writing; or

               (d)    in any other way approved by ACMA.

         (3)   A nominee of a relevant telephone account‑holder may apply only:

                (a)    in writing; or

               (b)    in any other way approved by ACMA.

Application by telephone

         (4)   A relevant telephone account‑holder who wishes to apply by telephone must:

                (a)    call a telephone number specified on:

                          (i)    if the Do Not Call Register is kept by ACMA — ACMA’s website; or

                         (ii)    if the Do Not Call Register is kept by the contracted service provider — the website of the contracted service provider;

                        from the telephone number sought to be checked; and

               (b)    provide the telephone number sought to be checked, including the area code, if any; and

                (c)    state that he or she is the relevant telephone account‑holder for the telephone number sought to be checked; and

               (d)    state that he or she would like the telephone number to be checked to see whether it has been registered.

         (5)   ACMA or the contracted service provider must, either:

                (a)    during the call; or

               (b)    as soon as practicable, by return call to the number sought to be checked;

advise the applicant whether the telephone number sought to be checked has been registered on the Do Not Call Register.

Application via the internet

         (6)   A relevant telephone account‑holder who wishes to apply via the internet must submit an application using the online application form on:

                (a)    if the Do Not Call Register is kept by ACMA — ACMA’s website; or

               (b)    if the Do Not Call Register is kept by the contracted service provider — the website of the contracted service provider.

         (7)   In the application, the relevant telephone account‑holder must:

                (a)    enter the telephone number to be checked, including the area code, if any; and

               (b)    state that he or she is the relevant telephone account‑holder for the telephone number sought to be checked; and

                (c)    state that he or she would like the telephone number to be checked to see whether it has been registered; and

               (d)    provide an email address, which may be used for:

                          (i)    general correspondence; and

                         (ii)    investigation of any possible abuse of the online checking process.

         (8)   ACMA or the contracted service provider must advise the applicant by return e‑mail, as soon as practicable, whether the telephone number sought to be checked has been registered on the Do Not Call Register.

Application in writing

         (9)   A relevant telephone account‑holder, or a nominee of a relevant telephone account‑holder, who wishes to apply in writing must send an application to:

                (a)    if the Do Not Call Register is kept by ACMA — a postal address or fax number specified on ACMA’s website; or

               (b)    if the Do Not Call Register is kept by the contracted service provider — a postal address or fax number specified on the website of the contracted service provider. 

       (10)   In the application, the relevant telephone account‑holder or nominee must:

                (a)    provide the telephone number sought to be checked, including the area code, if any; and

               (b)    state that he or she is the relevant telephone account‑holder, or a nominee of a relevant telephone account‑holder, for the telephone number sought to be checked; and

                (c)    state that he or she would like the telephone number to be checked to see whether it is on the Do Not Call Register; and

               (d)    provide a copy of a bill for the telephone account associated with the telephone number.

       (11)   If the applicant is a relevant telephone account‑holder, the applicant must also provide his or her contact details for correspondence.

       (12)   If the applicant is a nominee of a relevant telephone account‑holder, the applicant must also provide:

                (a)    written evidence of the nomination; and

               (b)    the name of the relevant telephone account‑holder; and

                (c)    his or her contact details and the contact details of the relevant telephone account‑holder, for correspondence.

       (13)   ACMA or the contracted service provider must advise the applicant in writing, as soon as practicable, whether the number sought to be checked is registered on the Do Not Call Register.

Applications before 14 May 2007

       (14)   Before 14 May 2007 an application may be made only:

                (a)    via the internet; or

               (b)    in writing; or

                (c)    in any other way approved by ACMA.

Note 1   ACMA and the contracted service provider (if any) are both bound by the Privacy Act 1988.

Note 2   No fee is payable for accessing the Do Not Call Register to check whether a telephone number has been registered.

Note 3   Giving false or misleading information is a serious offence, under section 137.1 of the Criminal Code.

10            Expiry of registration

                ACMA or the contracted service provider must, at the time of lodgement of an application for registration under section 4, inform the applicant that registration will take effect when entered on the Do Not Call Register, and will remain in force for three years, unless the entry is removed from the Do Not Call Register in accordance with section 6 or 7.

11            Handling of complaints when Do Not Call Register is kept by a contracted service provider

         (1)   This section applies if the Do Not Call Register is kept by a contracted service provider.

         (2)   The contracted service provider must deal with complaints and enquiries about the administration and operation of the Do Not Call Register.

         (3)   The contracted service provider must refer to ACMA any complaints about a breach of:

                (a)    the Act; or

               (b)    any regulations made under the Act; or

                (c)    any code made, or standard registered, under the Telecommunications Act 1997 that relates to the Do Not Call Register.

12            Requirement to provide a copy of a bill

                For paragraphs 4 (8) (f), 5 (6) (g), 7 (6) (d) and 9 (10) (d) it is sufficient to provide an edited copy of a bill, or a part of a bill, which shows the name of the relevant telephone account‑holder and the telephone number.
