The Australian Government Disaster Recovery Payment provides an immediate, short-term payment to Australians affected by a major or widespread disaster. This Determination sets out the circumstances in which persons are taken to be adversely affected by the Victorian bushfires that started in December 2006; and if they continue after December 2006 – that continued in January 2007.

I, MALCOLM THOMAS BROUGH, Minister for Families, Community Services and Indigenous Affairs, make this Determination under subsection 1061L(2) of the Social Security Act 1991.

1                    Name of Determination

 

This Determination is the Social Security (Australian Government Disaster Recovery Payment) Determination (No. 2) 2006.

 

2                    Commencement

 

This Determination commences on 15 December 2006.

 

3                    Definitions

 

In this Determination:

 

Act means the Social Security Act 1991.

 

principal place of residence, for a person, means the place in which the person normally resides.

 

4                    Person taken to be adversely affected by disaster

For subsection 1061L(2) of the Act, a person is adversely affected by the disaster mentioned in Schedule 1 if the person is affected in the way mentioned in Schedule 2.

Schedule 1        Disaster

                             (section 4)

 

The bushfires in the State of Victoria:

(a)        that started in December 2006; and

(b)        if they continue after December 2006 — that continued in January 2007.

 

 

Schedule 2        Adverse circumstances

                             (section 4)

 

As a direct result of the bushfires mentioned in Schedule 1, the person’s principal place of residence has been destroyed or rendered uninhabitable.
