I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Ordinance under the Cocos (Keeling) Islands Act 1955.

An Ordinance to amend the Land Act 1933 (W.A.) (C.K.I.), the Local Government Act 1960 (W.A.) (C.K.I.), the Strata Titles Act 1985 (W.A.) (C.K.I.), the Town Planning and Development Act 1928 (W.A.) (C.K.I.) and the Transfer of Land Act 1893 (W.A.) (C.K.I.).

Short Title

               1.   This Ordinance may be cited as the Land Legislation Ordinance 1992.1

[NOTE:            This Ordinance commences on gazettal:  see subsection 12(2) of the Cocos (Keeling) Islands Act 1955.]

Amendments

               2.   (1)  The Land Act 1933 (W.A.) (C.K.I.) is amended as set out in Part 1 of the Schedule.

              (2)   The Local Government Act 1960 (W.A.) (C.K.I.) is amended as set out in Part 2 of the Schedule.

              (3)   The Strata Titles Act 1985 (W.A.) (C.K.I.) is amended as set out in Part 3 of the Schedule.

              (4)   The Town Planning and Development Act 1928 (W.A.) (C.K.I.) is amended as set out in Part 4 of the Schedule.

              (5)   The Transfer of Land Act 1893 (W.A.) (C.K.I.) is amended as set out in Part 5 of the Schedule.

                                                  SCHEDULE                                       Section 2

AMENDMENTS OF LAND LEGISLATION

PART 1—AMENDMENTS OF THE LAND ACT 1933 (W.A.) (C.K.I.)

1.   New section 170a

1.1   After section 170, insert:

Address for service

       “170a.   Unless the contrary intention appears, a person may fulfil a requirement of this Act to provide an address within the limits of the city of Perth for service of notices or processes by providing an address in Perth or the Territory.”.

2.   New sections 176 , 177 and 178

2.1   After section 175, insert:


Creation of easements in gross for public amenities

          “176.   (1)     If a plan of survey of land in the Territory:

              (a)   was prepared on or before 30 June 1992; and

              (b)   is certified correct by the Surveyor-General of the Commonwealth; and

              (c)   identifies the location of equipment, pipes, cables, electrical transmission lines, structures or paths for the provision or maintenance by the Commonwealth of:

                           (i)   water, sewerage or drainage;

                          (ii)   electricity or other energy supply;

                         (iii)   telephone services;

                         (iv)   foreshore access;

                          (v)   jetties; or

                         (vi)   other public amenities; and

              (d)   is accepted for the purposes of this section by an authorised land officer and signed by that officer;

then an easement is granted in favour of the Commonwealth for the purpose of the provision and maintenance of, and access to, those services.

            “(2)   A plan of survey may be accepted by an authorised land officer for the purposes of this section without further survey.

            “(3)   The easement created under subsection 1 does not attach to a dominant tenement and will persist despite the alienation of any Crown land by the Commonwealth.

            “(4)   The Registrar of Titles, or the Registrar of Deeds, as the case requires, must register the easement upon the appropriate register.

            “(5)   This section does not affect the rights of any person to an easement otherwise acquired under common law, by agreement or by statute.

Dedication of existing public streets

          “177.   (1)     If a plan of survey of land in the Territory:

              (a)   was prepared on or before 30 June 1992; and

              (b)   is certified correct by the Surveyor-General of the Commonwealth; and


              (c)   identifies a road, street or highway for dedication as a public street; and

              (d)   is accepted by an authorised land officer for the purposes of this section and signed by that officer; and

              (e)   the dedication of that road, street or highway as a public street is approved by the Cocos (Keeling) Islands Shire council;

then the road, street or highway is dedicated as a public street by this section, in spite of any failure to comply with the requirements of Part XII of the Local Government Act 1960  (W.A.) (C.K.I.).

            “(2)   A plan of survey may be accepted by an authorised land officer for the purposes of this section without further survey.

            “(3)   If the road, street or highway is on Crown land, then absolute property in the road, street or highway vests in the Cocos (Keeling) Islands Shire council.

            “(4)   If the road, street or highway is on land owned by the Cocos (Keeling) Islands Shire council, then absolute property in the road, street or highway remains vested in the Cocos (Keeling) Islands Shire council.

Acceptance of survey for inclusion in records

          “178.   An authorised land officer may accept for inclusion in the records maintained by that officer in relation to the Territory a plan of survey of land in the Territory which :

              (a)   was prepared on or before 30 June 1992; and

              (b)   is certified correct by the Surveyor-General of the Commonwealth;

without carrying out a further survey.”.

PART 2—AMENDMENTS OF THE

LOCAL GOVERNMENT ACT 1960 (W.A.) (C.K.I.)

1.       Section 286 (Property in Streets)

1.1     Omit the section, substitute:


Property in streets

          “286.   (1)     In this section, “Shire council” means the Cocos (Keeling) Islands Shire council.

            “(2)   This section applies where a road, street or highway is reserved, declared or otherwise dedicated, under this or another applied law, a Commonwealth Act or a Territory Ordinance.

            “(3)   If the road, street or highway is on land owned by the Shire council then property in the land remains vested in the Shire council.

            “(4)   If the road, street or highway is on land which is not owned by the Shire council then:

              (a)   property in the land vests by this section in the Shire council; and

              (b)   the person who has title to the land before the dedication of the road, street or highway must deliver up the Documents of Title to the appropriate registration authority; and

              (c)   the Registrar of Titles or the Registrar of Deeds, as the case requires, must record the title in the Shire council.

              (5)   Except as provided in paragraph (4)(c), the Transfer of Land Act  1893 (W.A.) (C.K.I.) does not apply to land upon which that road, street or highway is located.

              (6)   This section does not affect rights, if any, to mines of coal or other minerals excepted from acquisition of land so reserved, declared or dedicated.”.

2.   Section 287 (Approval of provision or alteration of street)

2.1   Paragraph 287 (4) (a):

Add at the end:

                        “(iii)   the street was used by the public as a street before 1 July 1992; or”.

3.   Section 288 (Declaration of dedication of public streets)

3.1   Subparagraph 288 (4) (a) (iv):

Add at the end “or”.


3.2   Paragraph 288 (4) (b):

Add at the end “or”.

 

3.3   Paragraph 288 (4) (d):

Add at the end:

          “; or (e)       the land that is the subject of the request was used by the public as a street before 1 July 1992.”.

4.   Section 294a (Provision of streets in subdivisions under the Land Act 1933)

4.1   Subsection 294a (1):

Omit “; but no way not exceeding six metres in width shall be dedicated by virtue of this section”.

5.   Section 295 (Provision of streets in subdivisions under the Town Planning and Development Act 1928)

5.1   Subsection 295 (5):

Omit all the words after “the council has the care, control and management of it”.

PART 3—AMENDMENTS OF THE

STRATA TITLES ACT 1985 (W.A.) (C.K.I.)

1.   Section 23 (Certificate of local government authority)

1.1   Paragraph 23 (1) (a):

After “inspected and”, insert “, subject to subsection (1a),”.

1.2   After subsection 23 (1), insert:

         “(1a)   The local government authority is not required to certify that a building shown on a strata plan is consistent with building plans and specifications approved for the building, if:

              (a)   the building was commenced before 1 July 1992; and

              (b)   the authority did not require the plans for the building to be approved.”.


PART 4—AMENDMENTS OF THE TOWN PLANNING AND DEVELOPMENT ACT 1928 (W.A.) (C.K.I.)

1.    Section 2 (Interpretation)

1.1   Omit the definition of “public authority”, substitute:

“‘public authority’ means:

              (a)   a Minister of the Crown acting in his or her official capacity;

              (b)   a Commonwealth or State Government department, trading concern, instrumentality or public utility; and

              (c)   any other person or body, whether corporate or not, who or which, under the authority of any applied law, Commonwealth Act or Territory Ordinance, administers or carries on for the benefit of the Territory, the State or the Commonwealth, a social service or public utility;”

2.   New section 20aa

2.1   After section 20a, insert:

Vesting of access areas and reserves in Shire Council

      “20aa.   (1)  This section applies when:

              (a)   the Commission has approved, under this Act, a subdivision of land on the condition that parts of the land shown on a diagram or plan of survey of the subdivision as approved vest in the Cocos (Keeling) Islands Shire council for the purpose of:

                           (i)   conservation or protection of the environment; or

                          (ii)   a waterway; or

                         (iii)   a pedestrian accessway; or

                         (iv)   a right-of-way; or

                          (v)   a reserve for water supply, sewerage, drainage, foreshore management, waterway management or recreation; and

              (b)   the diagram or plan is received, registered or deposited in the Office of Titles or Registry of Deeds.


            “(2)   The Registrar of Titles or the Registrar of Deeds must vest in the Council the parts of the land:

              (a)   in accordance with the condition; and

              (b)   without a conveyance, transfer, assignment or payment of a fee.”.

3.   Section 27a (Easements)

3.1   Subparagraph 27A(1)(b)(i):

Omit the subparagraph .

 

3.2   Paragraph 27A(1)(b):

Insert after subparagraph (iv):

                        “(v)   the Crown for the provision and maintenance of, and access to:

                                 —water, sewerage or drainage;

                                 —electricity or other energy supply;

                                 —telephone services;

                                 —foreshore access;

                                 —jetties; or

                                 —any other public amenity; or

                        “(vi)   the Cocos (Keeling) Islands Shire council for the provision and maintenance of, and access to:

                                 —water, sewerage or drainage;

                                 —electricity or other energy supply;

                                 —telephone services;

                                 —foreshore access;

                                 —jetties; or

                                 —any other public amenity;”.

PART 5—AMENDMENTS OF THE

TRANSFER OF LAND ACT 1893 (W.A.) (C.K.I.)

1.   Section 4 (Interpretation)

1.1   Subsection 4 (1) (definition of “Grant”):

After “Majesty”, insert “or the Commonwealth”.

2.   Section 10 (Seal of Office)

2.1   Omit “Office of Titles of Western Australia”, substitute “Office of Titles of the Commonwealth”.

3.   Section 81A (Registration of Crown Leases)

3.1   Omit the section, substitute:

Registration of Crown leases

         “81a.   (1)  An original and a duplicate of a Crown lease issued after the date of commencement of this section must be:

              (a)   issued under seal; and

              (b)   forwarded by the Minister for Lands to the Registrar for registration under sections 53 and 54.

            “(2)   The Registrar must register the lease:

              (a)   by allocating a distinctive reference to it; and

              (b)   making any other notation on the lease and duplicate lease which the Registrar considers appropriate.”.

4.   Section 169a (Territory transition)

4.1   Section 169a:

Omit “for inclusion in the Register Book”.
