SR 1996 No. 172 Declarations/Superannuation as made
Amends the Schedule to the Superannuation (PSS) Membership Exclusion Declaration by adding to the Schedule item 37 describing a new class of persons to whom PSS membership is not available. The new class of persons are those employees appointed to the ACT Government Service under section 19 of the Public Sector Management (Consequential and Transitional Provisions) Act 1994 who were not members of the PSS immediately before their appointment under that Act, and have elected in writing their preference to be excluded from PSS membership, before the commencement of the Declaration. These employees have the option to join the PSS at any time after the Declaration takes effect.

Superannuation (PSS) Membership Exclusion Declaration2 (Amendment)

I, JOHN JOSEPH FAHEY, Minister for Finance, make the following Declaration under paragraph 6 (2) (c) of the Superannuation Act 1990.

1.   Amendment

1.1   The Superannuation (PSS) Membership Exclusion Declaration is amended as set out in this Declaration.

[NOTE: This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss. 46A and 48.]

2.   Schedule (Persons to whom section 6 of the 1990 Act does not apply)

2.1   Add at the end:

 

“37

A person who:

             (a)   because of a declaration made under subsection 19 (2) of the Public Sector Management (Consequential and Transitional Provisions) Act 1994 of the Australian Capital Territory, is taken to have been employed, on and after the day specified in the declaration:

                          (i)   as an officer or employee in a specified government agency under the Public Sector Management Act 1994 of that Territory; or

                         (ii)   by that Territory on indefinite tenure in a specified government agency under the Public Sector Management (Consequential and Transitional Provisions) Act 1994 of that Territory; and

             (b)   has not ceased to be so employed; and

             (c)   was not, immediately before the day specified in the declaration, a PSS member; and

             (d)   before the commencement of this item, has asked, in writing, not to be treated as a PSS member; and

             (e)   since the commencement of this item, has not asked, in writing, to become a PSS member.”.
