SR 1996 No. 4 Declarations/Superannuation as made
Amends the Schedule to the Superannuation (PSS) Membership Exclusion Declaration by adding to the Schedule item 36 describing a new class of persons to whom PSS membership is not available. This class is described as “a contributions-barred person” in respect of who under the Superannuation Industry (Supervision) Act 1993 contributions to a regulated superannuation fund cannot be accepted. The amendment further provides for persons who are PSS members at the commencement of this declaration and who remain members to be excluded from the effect of this declaration. Also excluded are persons who become PSS members after the commencement of the declaration and who later become persons included in the class.

Superannuation (PSS) Membership Exclusion  Declaration2 (Amendment)

I, KIM CHRISTIAN BEAZLEY, Minister for Finance, make the following Declaration under paragraph 6 (2) (c) of the Superannuation Act 1990.

1.   Amendment

1.1   The Superannuation (PSS) Membership Exclusion Declaration is amended as set out in this Declaration.

[NOTE: This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss. 46A and 48.]

2.   Schedule (Persons to whom section 6 of the 1990 Act does not apply)

2.1   Add at the end:



A person (in this item referred to as ‘a contributions-barred person’) in respect of whom, under the Superannuation Industry (Supervision) Act 1993, contributions to a regulated superannuation fund cannot be accepted, other than:

             (a)   a person who:

                          (i)   immediately before the commencement of this item, was a PSS member; and

                         (ii)   has since remained a PSS member; or

             (b)   a person (not being a person referred to in paragraph (a)) who:

                          (i)   immediately before becoming a contributions-barred person, was a PSS member; and

                         (ii)   has since remained a PSS member.”.
