CO 05/770 Orders/ASIC Class Orders as made
Class Order [CO 05/770] amends [CO 00/180], [CO 00/181], [CO 00/183], [CO 00/185] [CO 00/214], [CO 00/2338], [CO 03/184] and [CO 04/10], which provide fundraising and financial services regulation relief in connection with certain offers of shares in a class listed on an ASIC approved foreign financial market. The Class Order adds the JSE Securities Exchange South Africa to the list of approved foreign markets for the purposes of those class orders.

General Comments: ASIC Class Order [CO05/770] was published in the ASIC Gazette on 4 October 2005.
ASIC Class Orders [CO 03/184] and [CO 04/10] were repealed with effect from 8 April 2006 due to the operation of section 32 of the Legislative Instruments Act 2003.

Enabling legislation

1.         The Australian Securities and Investments Commission makes the variations set out in this instrument under subsections 283GA(1), 601QA(1), 655A(1), 741(1), 951B(1), 992B(1) and 1020F(1) and paragraph 911A(2)(l) of the Corporations Act 2001 (the Act).

Title

2.         This instrument is ASIC Class Order [CO 05/770].

Commencement

3.         This instrument commences on the later of:

(a)        the date of its gazettal; and

(b)        the date it is registered under the Legislative Instruments Act 2003.

(b)        Borsa Italiana;

(c)        Bourse de Paris;

(d)        Bursa Malaysia Main Board and Bursa Malaysia Second Board;

(e)        Eurex Amsterdam;

(f)         Frankfurt Stock Exchange;
