Quarantine Service Fees (Australia Post) Determination 2005

 

I, WARREN ERROL TRUSS, Minister for Agriculture, Fisheries and Forestry, make this Determination under section 86E of the Quarantine Act 1908.

1              Name of Determination

                This Determination is the Quarantine Service Fees (Australia Post) Determination 2005.

Note   This Determination takes effect on the day that it is registered on the Federal Register of Legislative Instruments.


2              Definitions

                In this Determination:

Act means the Quarantine Act 1908.

Australia Post means the Australian Postal Corporation.

postal article has the same meaning as in the Australian Postal Corporation Act 1989.

relevant financial year means the financial year 2005-2006 and each subsequent financial year.

Note   The terms payment day and quarantine service (used in this Determination) are defined in section 86E of the Act.

3              Fee for quarantine services payable by Australia Post

                (1)    For section 86E of the Act, the annual fee payable by Australia Post for the provision of quarantine services for postal articles received by Australia Post from places outside Australia is $3,200,000.         

                (2)    That annual fee is payable in respect of services carried out in each relevant financial year.

4              Due date for payment

                (1)    The annual fee referred to in section 3 is payable in equal instalments.

(2)   Each instalment is payable within 30 days of the date shown on each invoice issued by the Australian Quarantine and Inspection Service. 

5              Late payment fee

(1)   If an instalment is not paid on or before the payment day for that instalment, an additional fee (the late payment fee) is payable by Australia Post.

(2)   The late payment fee is:

                days overdue is the number of days after the payment day and before the day on which the instalment is paid.

6              Revocation of Quarantine Service Fees 2003-2005 (Australia Post) Determination 2003

 

            The Quarantine Service Fees 2003-2005 (Australia Post) Determination 2003 is revoked.
