MIGRATION AGENTS

(CONTINUING PROFESSIONAL DEVELOPMENT –

PREPARATION OF MATERIAL FOR PRESENTATION)

 

MARA NOTICE MN20-05 OF 2005

 

The Migration Agents Registration Authority, acting under clause 3 of Schedule 1 to the Migration Agents Regulations 1998:

 

(1)               REVOKES the notice entitled Migration Agents (Continuing Professional Development – Preparation of Material for Presentation) Notice No. MN28 of 2003, signed on 9 July 2003.

 

(2)               SPECIFIES that preparation of or presentation of written or oral material for use, in whole or part, in any of the following, is an approved activity:

 

(a)               an approved programme of education, conducted by a person or persons currently qualified by practical experience or academic qualifications in the subject matter of the course, that is comprehensive or refresher training;

 

(b)               an approved private study of audio, video or written material, for example recordings of approved activities;

 

(c)               an approved seminar, workshop, conference or lecture that is conducted by a person or persons currently qualified by practical experience or academic qualifications in the subject matter of the activity; and

 

(d)               an approved examination (such as an additional CPD assessment[1] or levelled standalone assessment[2]) mentioned at paragraph 8(a) of Schedule 1 of the Migration Agents Regulations 1998, where the examination is prepared by a person or persons currently qualified by practical experience or academic qualifications in the subject matter of the activity

 

However, the activity:

 

(a)               must have been completed on or after 1 April 1998;

 

(b)               must not be the preparation or presentation of material that is substantially in the same form as material which the migration agent has already claimed as any other approved activity; and

 

(c)               must be a core activity or an elective activity.

 

(3)               The activity of preparation or presentation is a core activity if:

 

(a)               the activity for which the material was prepared or where the materials were presented, was published in a MARA notice as an approved activity with core status, and

 

            (b)       it contributes in a positive manner to the development and practice of migration law.

 

(4)               The activity is an elective activity if:

 

(a)               the activity for which the material was prepared or where the materials were presented, was published in a MARA notice as an approved activity with elective status, and

 

(b)       it contributes in a positive manner to the development and practice of migration law.

 

(5)               The point value for preparation of or presentation of written or oral material for use, in whole or part, at an approved programme of education, for private study of audio, video or written material, at a seminar, workshop, conference or lecture or in an examination with an item number in the 1-99,000 series is 2 points.

 

(6)               The point value for preparation of or presentation of written or oral material for use, in whole or part, at an approved programme of education, for private study of audio, video or written material, at a seminar, workshop, conference or lecture or in an examination in the levelled series (that is with an item number of 100,000 to 700,000) series, is set out in column 4 in the Schedule, where the nature of the activities, and the status set out in columns 2 to 3 (inclusive) are satisfied.

 

 

This notice has effect on and from 1 April 1998.

[1] Optional activities conducted outside of the defined teaching period are linked to a specific attendance activity and are valued at 1 point and are in addition to any other assessment included within the activity.   Pre- requisites for the parameters of additional assessment must adhere to the guidelines set out in the MARA CPD Points Allocation Methodology.

[2] Where a CPD provider offers an external examination for migration agents, which tests their Knowledge of Migration Procedure and/or Skill Relating to the Application of Knowledge of Migration Procedure CPD points will be allocated.  The status of the points (core/elective) shall be determined by the content of the activity.  These activities must be conducted in accordance with the minimum standards outlined in the MARA CPD Points Allocation Methodology.
