Allows an extension of time to be given where a doctor has not paid the UMP Support Payment (UMPSP) by the due date under the Premium Support Scheme because of circumstances beyond the doctor's control, and removes the 1 May 2005 deadline for doctors to elect for their medical indemnity insurer to collect their UMPSP.

I, TONY ABBOTT, Minister for Health and Ageing, formulate this Scheme under subsection 43 (1) of the Medical Indemnity Act 2002.

Part 1        Preliminary

1.                      Name of Scheme [Note 1]

This Scheme is the Premium Support Amendment Scheme 2005 (No. 1).

2.                      Commencement

(1)        Subject to subsection (2), this Scheme commences on the date on which it is registered.

(2)        If this Scheme is registered after 30 April 2005, item 4 takes effect on 30 April 2005.

3.                      Amendment of the Premium Support Scheme 2004

The Schedule amends the Premium Support Scheme 2004.


Schedule - Amendments

[1]           Subsection 11(4)


     13  c)

and substitute:

     13 (1) (c)

[2]           Section 13 – Conditions for medical practitioners

Before the words 'The conditions' insert:


[3]           Paragraph 13 (c)

In paragraph 13 (c), omit:

     not later than 2 months after the payment day

and substitute:

     by the date specified in subsection (2)

[4]           Section 13

At the end of the section, insert:

     (2)     The date for paragraph (1) (c) is:

(a)            2 months after the payment day; or

(b)           such later date as is approved in writing by the HIC, not being a date later than 12 months after the end of the premium period, but that approval can be given only if the HIC is satisfied that the late payment was due to circumstances beyond the member's control.

                   Note  An example of circumstances beyond the member's control is where the member did not receive an invoice for the UMP support payment because the HIC did not have the member's correct mailing address.

(3)    The HIC may require the member to provide a statutory declaration setting out the reasons why the payment was not made by the date specified in paragraph (2) (a).

(d)    a decision of the HIC under paragraph 13 (2) (b) not to approve a later date.
