Determination No. 3 of 2000

 

 

 

I, JEANETTE RICKETTS, Branch Head, Income Support and a delegate of the Repatriation Commission, Department of Veterans’ Affairs, make this determination, under paragraph 5H(12)(c) of the Veterans’ Entitlements Act 1986.

Veterans’ Entitlements Income Exempt Lump Sum Determination No. 3 of 2000

 

 

Part 1              Preliminary

 

 

1.1                   NAME OF DETERMINATION

 

This determination is the Veterans’ Entitlements Income Exempt Lump Sum Determination No.3 of 2000.

 

1.2                                     COMMENCEMENT

 

This determination commences on the day on which it is signed.

 

1.3                   DEFINITIONS

 

In this determination:

 

Act means the Veterans’ Entitlements Act 1986.

 

Newstart customer means a person in receipt of a newstart allowance under Part 2.12 of the Social Security Act 1991.

 

Welfare Reform Pilot means:

 

(a)   the Mature Age Participation Pilot;

(b)   the Workless Families Assistance Pilot; or

(c)   the tailored Assistance for the Very Long Term Unemployed Pilot.

Part 2              Exempt Lump Sums

 

 

2.1                   AMOUNT OR CLASS OF AMOUNTS

 

(1)   Paragraph 5H(12)(c) of the Act provides that an amount or class of amounts, received by a person is an exempt lump sum if the amount, or class of amounts is determined by Commission to be an exempt lump sum.

 

(2)   In the 2000-2001 Budget, the Government announced three initiatives, known as the Welfare Reform Pilots, that would provide financial assistance to participants in relation to:

 

            (i)        a trial of a new approach to mature aged people without jobs;

 

          (ii)        test the effectiveness of approaches to facilitating economic and social participation amongst workless families with school age children; and

 

        (iii)        intensive interviews with Newstart customers who have been receiving income support for 5 years or more to improve their employment prospects.

 

(3)   A person, being a participant in any Welfare Reform Pilots, may be provided financial assistance of up to $500 to assist with the costs of services or items to help find employment or increase economic or social participation associated with the Pilots.

 

(4)   A person being a participant in the Mature Age Participation Pilot, may be provided additional financial assistance of $50, to reimburse that person for any expenses associated with that person’s participation in the Mature Age Participation Pilot, if:

 

(a)   the person completes the Pilot; and

(b)   the person undertakes an exit interview after completion of the Pilot

 

2.2                   APPLICATION-EXEMPT LUMP SUMS

 

(1)   It is appropriate to determine that an amount, or class of amounts, paid to a person, on or after the commencement of this Determination, in accordance with the requirements of subclause 2.1(3) of this Determination, is an exempt lump sum for the purposes of paragraph 5H(12)(c) of the Act from the date that the amount is paid.

 

(2)   It is appropriate to determine that an amount, or class of amounts, paid to a person, on or after the commencement of this Determination, in accordance with the requirements of subclause 2.1(4) of this Determination, is an exempt lump sum for the purposes of paragraph 5H(12)(c) of the Act from the date that the amount is paid.
