FACULTY AND FACULTY BOARD (JOHN CURTIN SCHOOL OF MEDICAL RESEARCH) RULES 2005

 

The Council of the Australian National University, makes these Rules under section 9 of the Faculties and Faculty Boards (Institute of Advanced Studies) Statute.

PART 1 - PRELIMINARY

Citation

1.(1) These Rules may be cited as the Faculty and Faculty Board (John Curtin School of Medical Research) Rules 2005.

(2)       These Rules commence on 31 December 2004, immediately after the commencement of the Rules (Repeal) Rules 2004.

Definitions

2.(1) In these Rules, unless the contrary intention appears:

"Director" means the Director of the Research School;

"Division" means a department of the Research School created by the Council by resolution and referred to in the resolution as a Division;

"Faculty" means the Faculty of the Research School;

"Faculty Board" means the Faculty Board of the Research School;

"Group" means a Group determined in accordance with rule 4;

"Head", in relation to a Division means a person appointed under subrule 3(1) to be the Head of the Division;

"Research School" means the John Curtin School of Medical Research;

"Statute" means the Faculties and Faculty Boards (Institute of Advanced Studies) Statute.

 (2) For the purposes of the Statute:

              (a)   a reference in these Rules to a Division is to be read as a reference to a department; and

              (b)   a reference in these Rules to the Head of a Division is to be read as a reference to the head of a department.

PART 2 - ADMINISTRATION

Head of Divisions

3.(1) There is to be a Head of each Division appointed by the Council on the recommendation of the Vice-Chancellor acting with the advice of the Director.

(2) Before giving advice under subrule (1), the Director must consult the Faculty Board and such other members of the Faculty as the Director thinks appropriate.

(3) Unless the Council otherwise determines, by resolution, in a particular case, a Head of a Division holds office for 2 years unless the Head sooner resigns from office by notice in writing to the Council.

(4) The term of office may be extended for another period of up to 2 years.

Groups

4.(1) Each Division is to comprise such Groups as are determined by the Director acting with the advice of the Faculty Board.

Group heads

5.(1) There is to be a head of each Group appointed by the Director.

(2) A Group head holds office for 3 years, unless the Group head sooner resigns from office by notice in writing to the Director, and may be reappointed.

PART 3 - THE FACULTY AND FACULTY BOARD

Membership of Faculty

6.(1) For the purposes of subsection 3(2) of the Statute, the following other persons are to be members of the Faculty:

              (a)   such visiting fellows as the Faculty Board determines, being fellows appointed for 1 year or more who are engaged in full-time research in the Research School;

              (b)   the research students in the School who are pursuing a program for the degree of Doctor of Philosophy;

              (c)   1 general staff representative elected by the general staff of each division and 1 general staff representative elected by the general staff of the School Services;

              (d)   such members of the staff of the University who are not otherwise members of the Faculty as the Faculty, by resolution, from time to time appoints;

              (e)   such persons, not being members of the staff of the University, as the Council appoints, being persons recommended by the Board of the Institute acting on the recommendation of the Faculty.

(2) A person who is chosen as, or appointed to be, a member of the Faculty under paragraph (1)(b) or (d) holds office for such term as the Faculty, at the time of the person becoming a member, by resolution, determines but may at any time, by notice in writing given to the Chair of the Faculty, resign from membership of the Faculty.

(3) A person elected under paragraph (1)(c) holds office for a period of 2 years from 1 January immediately following his or her election and is eligible for re-election.

(4) However, a person elected in 1999 under paragraph (1)(c) holds office from the date of his or her election until the end of 2000.

(5) A person who is appointed to be a member of the Faculty under paragraph (1)(e) holds office for such term as the Council determines, having regard to the term recommended by the Board of the Institute acting on the recommendation of the Faculty, but may at any time, by notice in writing given to the Chair of the Faculty, resign from membership of the Faculty.

Chair of Faculty

7.(1) There is to be a Chair of the Faculty, who must be elected by the members of the Faculty from their number in such manner as the Faculty, by resolution, determines.

(2) Subject to sub-rule (3), the Chair of the Faculty holds office until 14 September in the year next following the year of election, unless the Chair sooner resigns.

(3) In the event of a vacancy occurring in the office of the Chair of the Faculty, a member of the Faculty may be elected, in accordance with sub-rule (1), to the vacant office, and the member so elected holds office, subject to sub-rule (2), for the unexpired period of office of the Chair in whose place the member was so elected.

(4) A retiring Chair shall be eligible for re-election.

(5) The Chair of the Faculty must preside at all meetings of the Faculty at which the Chair is present, and, in the event of the Chair's absence from a meeting of the Faculty, the members of the Faculty present at the meeting must elect 1 of their number to preside at the meeting.

Membership of the Faculty Board

8. (1) For the purposes of subsection 4(2) of the Statute, the following other members of the Faculty are members of the Faculty Board:

              (a)   the Chair of the Faculty, if not otherwise a member of the Faculty Board;

              (b)   the Deputy Director of the Research School, if not otherwise a member of the Faculty Board;

              (c)   the Convenor of the Graduate Program in Medical Sciences, if not otherwise a member of the Faculty Board;

              (d)   a member chosen from each Division, by the members of the Faculty who are members of the Division, from among those professors, professorial fellows, senior fellows, fellows, senior research fellows, research fellows and postdoctoral fellows of the Division who are members of the Faculty and who are not otherwise members of the Faculty Board;

(e)  if no non-tenured member of the academic staff of the Research School is chosen under paragraph (d)-one member chosen by the Faculty from among those members of the Faculty who are non-tenured members of the academic staff of the Research School and who are not otherwise members of the Faculty Board;

(f)   such of those members of the Faculty, who are members of the academic staff of the Research School and who are not otherwise members of the Faculty Board, as the Council appoints on the recommendation of the Board of the Institute acting on the recommendation of the Faculty Board; and

(g)  a graduate student member of the Faculty, chosen by the student members of the Faculty enrolled in graduate research programs in the School.

(2) Unless the Faculty otherwise determines, by resolution, in a particular case, a member of the Faculty Board chosen in accordance with paragraph (1)(d) or (e) holds office for 2 years, and is not eligible to be chosen again for a term of office beginning less than one year after the end of the member's last term of office as a member of the Faculty Board.

(4) A person who is appointed to be a member of the Faculty Board under paragraph (1)(f) holds office for such term as the Council determines, having regard to the term recommended by the Board of the Institute acting on the recommendation of the Faculty Board, but may at any time, by notice in writing given to the Chair of the Faculty Board, resign from membership of the Faculty Board.

(5) A member of the Faculty Board chosen in accordance with paragraph (1)(g) holds office for 1 year.

(6) If a vacancy occurs in the office of a member of the Faculty Board chosen under paragraph (1)(d), (e) or (f), a member of the Faculty may be appointed to the vacant office in such manner as the Faculty, by resolution, determines, and the newly appointed member holds office for the remainder of the term of office for which the former member was appointed.

(7) A person who is appointed to a vacant office under sub-rule (6) and who holds that office for a period of more than 1 year is not eligible to be chosen under paragraph (1)(d), (e) or (f) for a term of office commencing less than 1 year after the termination of the first-mentioned term of office.

Meetings

9. (1) For the purposes of sub-section 5(2) of the Statute-

              (a)   the prescribed number of members of the Faculty is 4; and

              (b)   the prescribed number of members of the Faculty Board is 4.

(2) For the purposes of sub-section 5(5) of the Statute-

              (a)   the quorum at a meeting of the Faculty is 30 members; and

              (b)   the quorum at a meeting of the Faculty Board is such number of members of the Faculty Board as is equal to two-thirds of the total number of members for the time being of the Faculty Board or, where that fraction number is not a whole number, the next higher whole number.

(3) The agenda for each meeting of the Faculty is to be distributed to each member of the Faculty not less than 3 clear days before the date fixed for the meeting.
