I, PETER JOHN HOLLINGWORTH, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Commonwealth Authorities and Companies Act 1997.

1              Name of Regulations

                These Regulations are the Commonwealth Authorities and Companies Amendment Regulations 2002 (No. 1).

2              Commencement

                These Regulations commence on gazettal.

3              Amendment of Commonwealth Authorities and Companies Regulations 1997

                Schedule 1 amends the Commonwealth Authorities and Companies Regulations 1997.

4              Government business enterprises (Act, s 5)

                For the definition of GBE in section 5 of the Act, the following authorities and companies are prescribed:

                (a)    Australian Government Solicitor;

               (b)    Australian Postal Corporation;

                (c)    Australian Rail Track Corporation Limited;

               (d)    Australian Technology Group Limited;

                (e)    Bankstown Airport Limited;

                (f)    Camden Airport Limited;

               (g)    ComLand Limited;

               (h)    Defence Housing Authority;

                (i)    Employment National Limited;

                (j)    Health Services Australia Limited;

               (k)    Hoxton Park Airport Limited;

                (l)    Medibank Private Limited;

              (m)    Snowy Mountains Hydro-electric Authority;

               (n)    Sydney Airports Corporation Limited;

               (o)    Telstra Corporation Limited.

5              Statutory marketing authorities (Act, s 5)

                For the definition of SMA in section 5 of the Act, the following authorities are prescribed:

                (a)    Australian Dairy Corporation;

               (b)    Australian Wine and Brandy Corporation.

[4]           After paragraph 7 (1) (f)

insert

              (fa)    whether the company is:

                          (i)    a public company; or

                         (ii)    a large proprietary company; or

                        (iii)    a small proprietary company; or

                        (iv)    a company with only 1 member;

[5]           Subregulation 7 (3)

         (3)   In this regulation, each of the following terms has the meaning given by section 9 of the Corporations Act 2001:

                (a)    company limited by guarantee;

               (b)    company limited by shares;

                (c)    foreign company;

               (d)    large proprietary company;

                (e)    no liability company;

                (f)    small proprietary company;

               (g)    ultimate holding company;

               (h)    unlimited company.

         (4)   In this regulation:

public company means a company that is not a proprietary company within the meaning of section 9 of the Corporations Act 2001.
