I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Dairy Produce Act 1986.

1              Name of Regulations

                These Regulations are the Dairy Adjustment Authority Regulations 2000.

2              Commencement

                These Regulations commence on gazettal.

3              Definitions

                In these Regulations:

Act means the Dairy Produce Act 1986.

DAA means the Dairy Adjustment Authority established by clause 55 of Schedule 2 to the Act.

DAA Chair has the same meaning as in clause 2 of Schedule 2 to the Act.

DAA member has the same meaning as in clause 2 of Schedule 2 to the Act.

first DAA phase-down time has the same meaning as in subclause 58 (1) of Schedule 2 to the Act.

second DAA phase-down time has the same meaning as in subclause 58 (2) of Schedule 2 to the Act.

4              Convening and frequency of meetings

         (1)   The DAA may hold as many meetings as are necessary for the performance of its functions.

         (2)   Meetings of the DAA must be convened by the DAA Chair by notice in writing given to all of the DAA members.

         (3)   Meetings of the DAA are to be held at the time and place fixed by the DAA Chair in the notice mentioned in subregulation (2).

         (4)   If the DAA Chair receives notice in writing from the Minister, or, before the first DAA phase-down time, at least 2 of the DAA members, asking the DAA Chair to convene a meeting, the DAA Chair must convene a meeting as soon as practicable after receiving the notice.

5              Attendance at meetings

         (1)   A DAA member may participate in a meeting in person or by telephone.

         (2)   A DAA member who participates in a meeting by telephone is taken to be present at the meeting.

6              Quorum

                The quorum for a meeting of the DAA is:

                (a)    before the first DAA phase-down time, 3 DAA members; and

               (b)    after the first DAA phase-down time but before the second DAA phase-down time, 2 DAA members.

Note   After the second DAA phase-down time the DAA will consist of 1 member — see subclause 59 (4) of Schedule 2 to the Act.

7              Presiding member

         (1)   The DAA Chair must preside at all meetings of the DAA at which he or she is present.

         (2)   If the DAA Chair is to be absent from a meeting of the DAA, he or she may nominate a DAA member to preside at the meeting.

         (3)   If the DAA Chair is absent from a meeting of the DAA and has nominated a DAA member to preside at that meeting, that member must preside at that meeting.

         (4)   If the DAA Chair is absent from a meeting of the DAA and has not nominated a DAA member to preside at the meeting, then a majority of the DAA members present must elect one of their number to preside at the meeting.

         (5)   Subregulations (2), (3) and (4) do not apply after the first DAA phase-down period.

8              Voting

         (1)   Each DAA member present at a meeting of the DAA has a single vote.

         (2)   A question arising at a meeting of the DAA is to be decided by a majority of the votes of the DAA members present and voting.

         (3)   If the votes on a question before a meeting of the DAA are equal, the presiding member has a casting vote.

9              Minutes and records

                The DAA must keep minutes of its meetings and records of any resolutions taken to have been passed at its meetings.

10            Procedure

                So far as these Regulations do not provide for the procedure of the DAA, the DAA may determine its own procedure.
