1              Name of Regulations

                These Regulations are the Air Force Amendment Regulations 2000 (No. 1).

2              Commencement

                These Regulations commence on the commencement of Schedule 2 to the Defence Legislation Amendment Act (No. 1) 1999.

3              Amendment of Air Force Regulations 1927

                Schedule 1 amends the Air Force Regulations 1927.

4              Transitional

                Regulations 83, 84 and 85 of the Air Force Regulations 1927, as in force immediately before the commencement of these Regulations, continue to apply to an officer who has been given a notice under subregulation 83 (1) of the Air Force Regulations 1927 before the commencement of these Regulations.

      (5A)   At any time before the end of the period (including any extension), the officer may notify the Chief of Air Force in writing that the officer wishes to transfer to the Air Force Reserve at the end of the period.

      (5B)   If the officer notifies the Chief of Air Force under subregulation (5A), then at the end of the period:

                (a)    the officer is not retired from the Air Force under subregulation (3); and

               (b)    the officer is transferred to the Air Force Reserve.

[3]         Subregulation 75 (1)

         (1)   At any time before the end of the period of an appointment of a senior officer under section 9 or 9AA of the Defence Act, the officer may notify the Governor-General in writing that the officer wishes to transfer to the Air Force Reserve at the end of the period.

      (1A)   When the period of the appointment of the senior officer ends, the Governor-General must, as soon as practicable:

                (a)    if, before the end of the period, the officer has notified the Governor-General under subregulation (1) — transfer the officer to the Air Force Reserve; or

               (b)    if, before the end of the period, the officer has not notified the Governor-General under subregulation (1) — retire the officer from the Air Force.

79            Form and date of effect of transfer or retirement

         (1)   This regulation applies to:

                (a)    the transfer or retirement of a senior officer under subregulation 75 (1A); and

               (b)    the retirement of a senior officer under regulation 76; and

                (c)    the retirement of an officer under regulation 77 or 78.

         (2)   The transfer or retirement must:

                (a)    be in writing; and

               (b)    specify the day on which the transfer or retirement is to take effect.

         (3)   The specified day must be:

                (a)    not earlier than the day on which the officer is given a copy of the instrument that transfers or retires the officer; and

               (b)    not later than 3 months after the day mentioned in paragraph (a).

         (4)   The transfer or retirement takes effect on the day specified in the instrument as the day on which the officer is transferred or retired.

[6]         Subregulation 83 (1)

         (1)   The Chief of Air Force may give an officer a notice stating that if, in a specified period, the officer:

                (a)    retires from the Air Force; or

               (b)    notifies the Chief of Air Force in writing that the officer wishes to transfer to the Air Force Reserve;

                the officer will be entitled to a special benefit in accordance with a determination under section 58B or 58H of the Defence Act.

[7]         After subregulation 83 (3)

         (4)   If an officer:

                (a)    is given notice under subregulation (1); and

               (b)    notifies the Chief of Air Force under paragraph (1) (b);

                the officer may transfer to the Air Force Reserve in the period specified in the notice.

[10]      Regulation 85

85            Retirement or transfer of officers without special benefit

         (1)   This regulation applies to an officer:

                (a)    to whom a notice has been given under subregulation 83 (1); and

               (b)    who does not, within the period specified in the notice:

                          (i)    retire from the Air Force; or

                         (ii)    transfer to the Air Force Reserve; and

                (c)    in respect of whom the Chief of Air Force considers it is necessary to take action under this regulation in the interests of the organisational effectiveness of the Air Force.

         (2)   The Chief of Air Force may, at any time after the period specified in the notice given to the officer under subregulation 83 (1), give notice to the officer in accordance with subregulation (3).

         (3)   For subregulation (2), the notice is to the effect that the Chief of Air Force proposes to retire the officer at the end of a period (the relevant period) unless the officer notifies the Chief of Air Force in writing in the relevant period that the officer wishes to transfer to the Air Force Reserve at or before the end of that period.

         (4)   The period specified in the notice must be not less than 13 months starting on the day on which the notice is given to the officer.

         (5)   If the officer does not notify the Chief of Air Force as mentioned in subregulation (3), the Chief of Air Force may retire the officer at the end of the relevant period.

         (6)   For subregulation (5), the Chief of Air Force retires an officer by giving notice to the officer that the officer is retired from the Air Force at the end of the relevant period.

         (7)   An officer to whom notice is given under subregulation (6) is retired from the Air Force at the end of the relevant period.

         (8)   An officer who is retired under subregulation (7) is taken for all purposes to have been compulsorily retired from the Air Force.
