Archives Regulations2 (Amendment)

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Archives Act 1983.

1.   Commencement

1.1   These Regulations commence on gazettal.

2.   Amendment

2.1   The Archives Regulations are amended as set out in these Regulations.


Note   The following note is inserted at the end of regulation 2:

Note   Words and expressions that are defined in the Act and used in these Regulations have the same meaning in these Regulations as they do in the Act (see Acts Interpretation Act 1901, s 46 (1) (a)). For example, subsection 3 (1) of the Act contains a definition of Commonwealth institution and subsection 3 (3A) contains a definition of discretionary service.”.

3.   Regulation 10 (Discretionary services)

3.1   Paragraph 10 (b):

Omit “Part 2 of”.

4.   Regulation 11 (Charges)

4.1   Subregulations 11 (1) to (4):

Omit the subregulations, substitute:

           “11.   (1)    Subregulation (2) applies if a person is given:

             (a)   access to a record under paragraph 36 (2) (b) of the Act; or

             (b)   a copy of the Australian National Guide to Archival Material, or part of the Guide, under subsection 66 (6) of the Act.

           “(2)   The Archives may charge the person an amount equal to, or less than, the cost of giving the copy to the person, including the cost of:

             (a)   film, microfiche, disk or other article given to the person; and

             (b)   if the person asked for the copy to be posted or delivered—postage or delivery of the copy.

           “(3)   Schedule 1 sets out the charges for discretionary services given to a person other than a Commonwealth institution.

           “(4)   If a charge for a service mentioned in Schedule 1 is shown as a rate, and the service is given for a period that is or includes part of the period, the charge must be in proportion to the period that the service is given.”.

5.   Schedule 1

5.1   Omit the Schedule, substitute:

Serviced storage of records in an air-conditioned repository

(a)   for the first year of storage—$24.00 per metre of records

Serviced storage of records in an air-conditioned vault
