Jury Exemption Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Jury Exemption Act 1965.

1.   Amendment

1.1   The Jury Exemption Regulations are amended as set out in these Regulations.

2.   Regulation 4 (Exemption of certain Commonwealth employees)

2.1   Paragraph 4 (a):

After “courts;”, insert “and”.

3.   Regulation 5 (Exemptions relating to administration of justice)

3.1   Paragraph 5 (1) (a):

After “courts;”, insert “and”.

3.2   Subregulation 5 (2):

Omit “to:”, substitute “to the following persons:”.

3.3   Subparagraph 5 (2) (a) (i):

Omit the subparagraph, substitute:

                        “(i)   a Department; or”.

3.4   Subparagraphs 5 (2) (b) (i) and (ii):

After “Australia;”, insert “or”.

3.5   Subparagraphs 5 (2) (b) (iv) and (v):

Omit the subparagraphs.

3.6   Paragraphs 5 (2) (d), (da), (db), (e) and (f):

Omit the paragraphs.

3.7   Paragraph 5 (2) (g):

Omit “16”, substitute “26B”.

3.8   Paragraph 5 (2) (i):

Omit “a protective service officer or special protective service officer”, substitute “the Director,”.

3.9   Subparagraph 5 (2) (j) (i):

After “Intelligence;”, insert “or”.

3.10   Paragraph 5 (2) (k):

Omit “and”.

3.11   Paragraph 5 (2) (l):

Omit the paragraph, substitute:

            “(l)   a member, or a member of the staff, of the National Native Title Tribunal;

            (m)   a staff member, within the meaning of the Australian Securities Commission Act 1989, being a staff member whose duties involve:

                          (i)   providing legal professional services; or

                         (ii)   investigating matters.”.

4.   Regulation 6 (Exemptions relating to public need)

4.1   Paragraph 6 (1) (a):

After “courts;”, insert “and”.

4.2   Subregulation 6 (2):

Omit the subregulation, substitute:

           “(2)   This regulation applies to a veterinary officer or other person employed in the Department of Primary Industries and Energy whose duties relate to the planning, co-ordination and monitoring of measures to limit the importation of exotic diseases into, or outbreak of exotic diseases in, Australia.”.

5.   Regulation 7 (Exemptions relating to public administration)

5.1   Paragraph 7 (2) (d):

Omit the paragraph.

5.2   Paragraph 7 (2) (e):

Omit “Industrial Relations Act 1988”, substitute “Workplace Relations Act 1996”.

5.3   Subparagraph 7 (2) (g) (viii):

Omit “Sergeant-at Arms”, substitute “Serjeant-at-Arms”.

5.4   Subparagraphs 7 (2) (g) (ix) and (x):

Omit the subparagraphs, substitute:

                      “(ix)   Director (Programming), Table Office;

                         (x)   Director (Legislation and Records), Table Office;”.

5.5   Subparagraph 7 (2) (g) (xi):

After “Act;”, insert “and”.

5.6   Subparagraph 7 (2) (g) (xii):

Omit the subparagraph.

5.7   Paragraph 7 (2) (h):

Omit the paragraph, substitute:

           “(h)   a person holding, or for the time being performing the duties of, any of the following offices in the Department of the Parliamentary Reporting Staff:

                          (i)   Principal Parliamentary Reporter;

                         (ii)   Senior Executive Band 1;

                       (iii)   Director;

                        (iv)   Assistant Director;

                         (v)   Sound and Vision Officer Grade 4;

                        (vi)   Sound and Vision Officer Grade 3;

                      (vii)   Principal Editor;

                     (viii)   Senior Editor;

                        (ix)   Editor;

                         (x)   Keyboard Manager;

                        (xi)   Hansard Editorial Support Supervisor;

                      (xii)   Systems Administrator;

                     (xiii)   Assistant Systems Administrator;

                     (xiv)   Publishing Manager; and”.

5.8   Paragraph 7 (2) (ia):

Omit the paragraph.

5.9   Subparagraph 7 (2) (j) (ii):

Omit the subparagraph, substitute:

           “(ii)   Director-General, Alliance Policy and Management;”.
