Sea Installations (Permit Application Fees)

Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Sea Installations Act 1987.

Citation

1. These Regulations may be cited as the Sea Installations (Permit Application Fees) Regulations.

Interpretation

2. In these Regulations:

"cost of installation", in relation to an application for a permit to operate a sea installation, means:

(a) the actual costs incurred before the date of the application; and

(b) the estimated further costs;

of constructing, transporting and installing that sea installation;

"the Act" means the Sea Installations Act 1987.

Prescribed fees

3. (1) For the purposes of subsection 72 (1) of the Act, but subject to subregulation (2), the fees specified in the Schedule are prescribed in respect of applications for permits.

(2) The fees specified in the Schedule do not apply to an application in respect of a sea installation that was installed before the commencement of the Act in accordance with a permit granted under another law of the Commonwealth.

(3) For the purposes of subsection 72 (2) of the Act, the time prescribed for the payment of a fee for an application for a permit is 30 days after the application is made.
