Air Force Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Air Force Act 1923.

1.   Amendment

1.1   The Air Force Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 4 (Interpretation)

2.1   Subregulation 4 (3):

Omit the subregulation.

2.2   Subregulation 4 (8):

Omit the subregulation.

3.   Regulation 88 (Retiring ages for officers)

3.1   Subregulation 88 (1):

Omit “The age”, substitute “Subject to subregulation (1A), the age”.

3.2   Subregulation 88 (1) (table, Column 3):

Omit “45” (wherever occurring), substitute “55”.

3.3  After subregulation 88 (1), insert:

        “(1A)   The age for the compulsory retirement of an officer (other than an officer who is a chaplain of the Air Force) who:

             (a)   is included in the General List Branch or the General Duties Branch; and

             (b)   holds, and on the commencement of this subregulation, held, the substantive rank of Flight Lieutenant, Flying Officer, Pilot Officer or Officer Cadet;

is 45 years unless that officer elects, in accordance with subregulation (1AAA), to adopt the retirement age of 55 in relation to those ranks.

  “(1AAA)   An election for the purposes of subregulation (1A) must be in writing, signed by the officer, and delivered to the Chief of the Air Staff not later than:

             (a)   6 months after the commencement of this subregulation; or

             (b)   the attainment by the officer of the age of 45 years;

whichever is the earlier.”.

3.4   Subregulation 88 (1AA):

After “subregulation (1)”, insert “or (1A)”.

4.   Regulation 443B (Prescribed authority for the purposes of subsections 4J (3) and (4) of the Act)

4.1   Omit the regulation.

5.   Regulation 443E (Period of service after call out)

5.1   Omit the regulation.

6.   Regulation 468 (Termination of appointment of officers of the Air Force Reserve)

6.1   Omit the regulation.
