Air Force Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Air Force Act 1923.

1.   Amendment

1.1   The Air Force Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48.]

2.   Regulation 94 (Oath to be taken on enlistment)

2.1   Subregulation 94 (1):

Omit the subregulation, substitute:

          “ 94.   (1)    A person offering to be enlisted in any part of the Air Force must take and subscribe an oath, in the appropriate form set out in Schedule 1, before:

             (a)   an officer of the Air Force; or

             (b)   an officer of the Navy; or

             (c)   an officer of the Army; or

             (d)   a Warrant Officer of the Air Force; or

             (e)   a Warrant Officer of the Navy; or

              (f)   a Warrant Officer Class 1 of the Army; or

             (g)   a Justice of the Peace; or

             (h)   a Commissioner for Affidavits; or

              (i)   a Commissioner for Declarations.”.

3.   Regulation 95 (Affirmation in lieu of oath)

3.1   Subregulation 95(1):

After “he may”, insert “, before a person referred to in paragraph 94 (1) (a), (b), (c), (d), (e), (f), (g), (h) or (i),”.

4.   Schedule 1

4.1   Schedule 1, Part I:

Omit all the words after “(insert date)”, substitute:

                                                                  “(Insert signature, name and title of the person before whom the oath is taken and subscribed)

[NOTE:  The  oath may be taken before an officer of the Air Force, Navy or Army, a Warrant Officer of the Air Force or Navy, a Warrant Officer Class 1 of the Army, a Justice of the Peace, a Commissioner for Affidavits or a Commissioner for Declarations: see subregulation 94 (1).]”.


4.2  Schedule 1, Part II:

 Omit all the words after “(insert date)”, substitute:

                                                                  “(Insert signature, name and title of the person before whom the affirmation is made and subscribed)

 

[NOTE:  The  affirmation  may be made before an officer of the Air Force, Navy or Army, a Warrant Officer of the Air Force or Navy, a Warrant Officer Class 1 of the Army, a Justice of the Peace, a Commissioner for Affidavits or a Commissioner for Declarations: see subregulation  95 (1).]”.
