Superannuation (Continuing Contributions for Benefits) Regulations 2 (Amendment)

 

 

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Act 1976.

1.   Amendment

1.1   The Superannuation (Continuing Contributions for Benefits) Regulations are amended as set out in these Regulations.

 

[Note:  These Regulations commence on gazettal:  see Acts Interpretation Act 1901, s.48.]


2.   Regulation 2 (Interpretation)

2.1   Before the definition of “officer”, insert:

“ ‘ASP Ship Management’ means the partnership known by that name entered into between Marine Management Services Pty Ltd and Associated Steamships Pty Ltd;

‘employee of ASP Ship Management’ means a person employed by the partners of ASP Ship Management for the purposes of the partnership;”.

 

 

3.   Regulation 3A (Persons who remain eligible to contribute)

3.1   Add at the end:

             “(f)  a person who:

                           (i)  is an employee, other than a casual employee or temporary part-time employee, of ASP Ship Management; and

                          (ii)  has never been a casual employee or temporary part-time employee of ASP Ship Management; and

                         (iii)  has never been a member of a superannuation scheme, other than the scheme provided for under the Act, applying to the person’s employment by ASP Ship Management; and

                         (iv)  was an eligible employee immediately before becoming an employee of ASP Ship Management; and

                          (v)  was an employee of ANL Limited immediately before becoming an employee of ASP Ship Management.”.

 

 

4.   Regulation 4 (When s. 14A no longer applies)

4.1   Add at the end:

             “(5)  Section 14A of the Act ceases to apply to a person mentioned in paragraph 3(f) at the end of the day:

               (a)  on which the person ceases to be an employee of ASP Ship Management; or

               (b)  immediately before the day on which the person becomes a casual, or temporary part-time, employee of ASP Ship Management; or


               (c)  immediately before the day on which the person becomes a member of a superannuation scheme, other than the scheme provided for under the Act, applying to the person’s employment by ASP Ship Management.”.

 

 

5.   Schedule (Modifications of Act)

5.1   Item 2:

Omit the item, substitute:

 

2.   Section 159:

2.1   After subsection 159 (1), insert:

                ‘(1A)   This section applies to:

                    (a)   AIDC Ltd; and

                    (b)   the Dairy Research and Development Corporation; and

                     (c)   a Commonwealth authority, within the meaning of Part IV of the Public Service Act, that is not an approved authority; and

                    (d)   the Northern Land Council; and

                     (e)   ASP Ship Management.’.

 

2.2   Subparagraph 159 (2) (a) (ii):

After ‘(1) (b)’, insert ‘or (1A) (a), (b), (c), (d) or (e)’.”.
