Superannuation (Continuing Contributions for Benefits) Regulations 2 (Amendment)

 

 

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Act 1976.

1.   Amendment

1.1   The Superannuation (Continuing Contributions for Benefits) Regulations are amended as set out in these Regulations.

 

 

 

2.   Regulation 3a (Classes of persons to which section 14a of the Act applies)

2.1   Add at the end:

             “(d)  a class of persons each of whom:

                           (i)  is:
(A)       the Executive Director (if he or she holds                     office on a full-time basis); or

                                 (B)       an employee (other than a person employed                 on a casual basis or part-time on a                temporary basis);

                                 of the Dairy Research and Development Corporation; and

                          (ii)  was an eligible employee (other than a person to whom Part IV of the Public Service Act applied) immediately before becoming, or last becoming, a person specified in subparagraph (i); and

                         (iii)  since becoming, or last becoming, a person specified in subparagraph (i), has not been a member of a superannuation scheme applying in relation to that person’s employment (if any) with the Dairy Research and Development Corporation, other than the scheme constituted by the provisions of the Act; and

                         (iv)  is not a person to whom Part IV of the Public Service Act applies.”.

 

3.    Schedule (Modifications of the Act)

3.1   Item 2:

Add at the end of the definition of “prescribed authority” in inserted subsection 159a (1) of the Act:

               “or

                     (c)   the Dairy Research and Development Corporation;”.

 

3.2   Item 2:

Add at the end of the definition of “relevant person” in inserted subsection 159a (1) of the Act:

             “; or

                (c)   where the prescribed authority is the Dairy Research and Development Corporation, the Executive Director of that Corporation if he or she holds office on a full-time basis.”.
