Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Superannuation Act 1976.

Persons not included in definition of “eligible employee”

Regulation 4 of the Superannuation (Eligible Employees) Regulations is amended by adding at the end the following paragraph:

(y) persons (including persons specified in a direction given under section 11, 12, 13 or 14 of the Act) who are Directors within the meaning of the Snowy Mountains Engineering Corporation Act 1970 or are persons appointed or engaged under section 39 of that Act, other than:

(i) persons who, immediately before the commencement of this paragraph, were eligible employees and were at that time, and have at all times after that time been, such Directors or persons so appointed or engaged;

(ii) persons who are, during a period when they are on leave without pay from employment by the Commonwealth or an approved authority other than the Snowy Mountains Engineering Corporation, such Directors or persons so appointed or engaged;

(iii) invalidity pensioners; and

(iv) persons to whom Division 2 or 3 of Part IV of the Public Service Act applies.
