Superannuation (Salary) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Act 1976.

1.    Amendment

1.1   The Superannuation (Salary) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Part 2e (Certain employment agreements)

2.1   Omit the Part heading, substitute:

PART 2e—FLEXIBLE REMUNERATION PACKAGES”.

3.   Regulation 8p (Interpretation)

3.1   Omit the definitions of “relevant authority” and “relevant office”.

4.   Regulation 8q (Executive employees—flexible remuneration packages)

4.1   Omit the regulation, substitute:

Executive employees—flexible remuneration packages

          “8q.   (1)    This regulation applies, subject to regulation 8qa, to an eligible employee who:

             (a)   is appointed or employed by an authority or body mentioned in column 2 of an item in Part 1 of Schedule 1; or

             (b)   is appointed or employed by or under a law mentioned in column 2 of an item in Part 2 of Schedule 1; or

             (c)   holds an office mentioned in column 2 of an item in Part 3 of Schedule 1;

under, or in accordance with, a relevant agreement.

           “(2)   For the purposes of the Act, the annual rate of salary on a particular day of an eligible employee to whom this regulation applies is an amount equal to the total yearly value on that day of that employee’s remuneration (including his or her non-monetary entitlements) under that agreement, multiplied by the percentage set out in column 3 of the item in Schedule 1 that applies to the eligible employee.”.

5.   Schedule 1 (Percentage rates for certain eligible employees)

5.1   Part 1:

Omit the heading, substitute:

part 1—employees of certain authorities
or bodies
”.

5.2   Part 2 (Employees holding office under certain laws)

Omit the heading, substitute:

PART 2—PERSONS APPOINTED OR EMPLOYED UNDER CERTAIN LAWS”.

5.3   Part 2 (Persons appointed or employed under certain laws):

Omit items 3, 4 and 5.

5.4   Insert after Part 2:
