Defence (Areas Control) Regulations 2 (Amendment)
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Defence Act 1903.

1. Amendment
1.1 The Defence (Areas Control) Regulations are amended as set out in these Regulations.
2. Regulation 8 (Applications for approval)
2.1 Subregulation 8 (2):
Omit “referred to in the notice”, substitute “reasonably required for a proper consideration of the application”.
3. Regulation 12 (Hazardous objects)
3.1 After “not”, insert “, without reasonable excuse,”.
4. Regulation 13 (Removal or marking of hazardous objects)
4.1 Subregulation 13 (1):
Omit “given directions”, substitute “give directions”.
5. Regulation 15 (Powers of authorised persons)
5.1 After subregulation 15 (3), insert:
“(3A) A person may not enter land or premises under subregulation (1) or (2) unless:
(a) written notice is given to each person who the Minister believes has an interest in the land or premises (other than by way of a mortgage or other security); and
(b) the notice states that authorised persons may enter the land no earlier than 7 days after service of the notice; and
(c) the notice sets out particulars of the acts to which the authorisation to enter the land or premises extends and the purposes for which those acts may be done; and
(d) at least 7 days have elapsed since the notice was given to each of the persons referred to in paragraph (a).”.
5.2 Subregulation 15(4)
After “Regulations,”, insert “wilfully”.
5.3 Subregulation 15(5):
After “not”, insert “wilfully”.
6. Regulation 17 (Compensation for loss of value of affected land)
6.1 Subregulation 17(12):
Omit “claimed”, substitute “held”.
