Superannuation (Retiring Age) Regulations2 (Amendment)
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Superannuation Act 1976.

Minimum retiring age
Regulation 5 of the Superannuation (Retiring Age) Regulations is amended by inserting after sub-regulation (4) the following sub-regulation:
“(4a) For the purposes of the definition of ‘minimum retiring age’ in sub-section 3 (1) of the Act, the age of 50 years is the minimum retiring age applicable to—
(a) an eligible employee who is an employee within the meaning of the Commonwealth Employees (Redeployment and Retirement) Act 1979 and whose minimum retiring age under that Act is the age of 50 years; and
(b) a person who—
(i) has ceased to be, and is not, an eligible employee referred to in paragraph (a); and
(ii) was, on his last day of service, such an eligible employee.”.
