Superannuation (Retiring Age) Regulations2 (Amendment)
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Superannuation Act 1976.

Minimum retiring age
Regulation 5 of the Superannuation (Retiring Age) Regulations is amended—
(a) by adding at the end of sub-regulation (1) the following paragraphs:
“(v) an officer of the Overseas Telecommunications Commission (Australia);
(w) an officer of the Pipeline Authority;
(x) an employee of the Anglo-Australian Telescope Board;
(y) a person (other than a prescribed person) who is the holder of a statutory office and whose minimum retiring age, in accordance with the terms and conditions on which he holds that office, is 55 years.”;
(b) by inserting in sub-regulation (2) “appointment or engagement (as the case may be),” after “employment,”;
(c) by omitting from paragraph (5) (b) “or”; and
(d) by adding at the end of sub-regulation (5) the following paragraphs:
“(d) a member of the National Companies and Securities Commission;

(e) a person who holds office as a Secretary under a fixed-term appointment made in accordance with section 37 of the Public Service Act;
(f) a person who holds office as a Senior Executive Service officer under a fixed-term appointment made in accordance with section 44 of the Public Service Act;
(g) a person engaged, under an agreement made in accordance with section 4 of the Members of Parliament (Staff) Act 1984, as a consultant;
(h) a person employed, under an agreement made in accordance with section 13 of the Members of Parliament (Staff) Act 1984, as a member of an office-holder’s staff; or
(j) a person employed, under an agreement made in accordance with section 20 of the Members of Parliament (Staff) Act 1984, as a member of the staff of a Senator or Member of the House of Representatives.”.
