Foreign Judgments Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and being satisfied, in respect of New Zealand, of the matters specified in subsections 5 (1) and (3) of the Foreign Judgments Act 1991, make the following Regulations under the Act.

Citation

               1.   These Regulations may be cited as the Foreign Judgments  Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48.]

Interpretation

               2.   In these Regulations:

“the Act” means the Foreign Judgments Act 1991.

Extension of Part 2 of the Act

               3.   Part 2 of the Act extends to each country specified in column 2 of the Schedule.

Specified superior courts

               4.   For the purposes of the Act, the courts specified in column 3 of an item in the Schedule are taken to be superior courts of the country specified in column 2 of that item.

Specified inferior courts

               5.   Part 2 of the Act extends in relation to each District Court of New Zealand.
