Veterans’ Entitlements (Rehabilitation Allowance) Regulations2 (Amendment)

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Veterans’ Entitlements Act 1986.

1.      Amendment

1.1    The Veterans’ Entitlements (Rehabilitation Allowance) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.      Regulation 9 (Notice of Commission’s decision)

2.1    Add at the end:

           “(3)   The Commission must give written notice of its decision under subparagraph 5 (a) (ii) to the veteran who has undertaken the program of vocational rehabilitation.

           “(4)   A notice under subregulation (3) that relates to a decision not to approve a program of vocational rehabilitation must include the reasons for the decision.”.

3.      Regulation 10 (Review of decisions)

3.1    Subregulation 10 (1):

Omit the subregulation, substitute:

           “(1)   Application may be made to the Administrative Appeals Tribunal under the Administrative Appeals Tribunal Act 1975 for review of a decision of the Commission:

             (a)   under subparagraph 5 (a) (ii); or

             (b)   under regulation 7 or 8.”.

3.2    Subregulation 10 (2):

Omit “subregulation (1),’, substitute “paragraph (1) (b),”.
