A Bill for an Act to amend the Australian Education Act 2013, and for related purposes
The Parliament of Australia enacts:
1 Short title
This Act is the Australian Education Amendment (Save Our Public Schools) Act 2023.
2 Commencement
(1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Schedules
Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect.
Schedule 1—Amendments
Australian Education Act 2013
1 At the end of section 3
Add:
; and (c) to ensure every school‑aged child in Australia has access to a fully funded government school.
2 Section 35A
Repeal the section, substitute:
35A Commonwealth share
Commonwealth share
(1) The Commonwealth share for a school for a year (subject to sections 35B and 35C) is:
(a) for a government school—25%, unless the regulations prescribe a higher percentage; and
(b) for a non‑government school—80%, unless the regulations prescribe otherwise.
Objective of the Commonwealth share
(2) Before the Governor‑General makes regulations for the purposes of subsection (1), the Minister must be satisfied that the regulations are consistent with the objective stated in subsection (3).
(3) The objective is that every school‑aged child in Australia has access to a fully funded government school.
(4) To avoid doubt, subsections (2) and (3) do not apply to the Commonwealth share for a transitioning government school or a non‑government school for a transition year (see sections 35B and 35C).
