A Bill for an Act to amend the Public Governance, Performance and Accountability Act 2013, and for related purposes
The Parliament of Australia enacts:
1 Short title
This Act is the Public Governance, Performance and Accountability Amendment (Vaccine Indemnity) Act 2023.
2 Commencement
(1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Schedules

Schedule 1—Amendments
Public Governance, Performance and Accountability Act 2013
1 After section 61
Insert:
61A Vaccine indemnities
(1) The Finance Minister must not grant an indemnity on behalf of the Commonwealth to a manufacturer of a vaccine in relation to the use of the vaccine.
(2) A corporate Commonwealth entity must not grant an indemnity to a manufacturer of a vaccine in relation to the use of the vaccine.
(3) This section applies despite sections 60 and 61, and any rules made for the purposes of those sections.
(4) In this section:
manufacturer, in relation to a vaccine, includes a person who is or is to be a sponsor of the vaccine within the meaning of the Therapeutic Goods Act 1989.
vaccine means a vaccine for the purpose of immunising persons.
2 Application of amendments
Section 61A of the Public Governance, Performance and Accountability Act 2013, as inserted by this Schedule, applies in relation to the granting of indemnities on or after the day this item commences.
