A Bill for an Act to update references to prescribed forms in the statute law of the Commonwealth, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act is the Statute Law Amendment (Prescribed Forms) Act 2021.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

A single day to be fixed by Proclamation.

However, if the provisions do not commence within the period of 6 months beginning on the day this Act receives the Royal Assent, they commence on the day after the end of that period.

 

3.  Schedule 1, item 56

The later of:

(a) immediately after the commencement of the provisions covered by table item 2; and

(b) immediately after the commencement of Part 3 of Schedule 7 to the Designs Amendment (Advisory Council on Intellectual Property Response) Act 2021.

However, the provisions do not commence at all if the event mentioned in paragraph (b) does not occur.

At the same time as the provisions covered by table item 2.

 

Note:          This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act.

             (2)  Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

  

Aboriginal and Torres Strait Islander Heritage Protection Act 1984

1  Subsection 17(2)

Omit “the form prescribed”, substitute “the form approved in an instrument under subsection (2A)”.

2  After subsection 17(2)

Insert:

          (2A)  The Minister may, by notifiable instrument, approve a form for the purposes of subsection (2).

3  Application provision

The amendments of the Aboriginal and Torres Strait Islander Heritage Protection Act 1984 made by this Schedule apply in relation to identity cards issued after the commencement of this item.

Agricultural and Veterinary Chemicals (Administration) Act 1992

4  Section 69EAA (definition of approved form)

Omit “or prescribed by the regulations”.

Airports Act 1996

5  Subsection 142(5)

Omit “be in the prescribed form”, substitute “contain the information prescribed by the regulations”.

6  Application provision

The amendment of the Airports Act 1996 made by this Schedule applies in relation to certificates given after the commencement of this item.

Australian Radiation Protection and Nuclear Safety Act 1998

7  Subsection 62(3)

Omit “the form prescribed by the regulations”, substitute “the form approved in an instrument under subsection (3A)”.

8  After subsection 62(3)

Insert:

          (3A)  The CEO may, by notifiable instrument, approve a form for the purposes of subsection (3).

9  Application provision

The amendments of the Australian Radiation Protection and Nuclear Safety Act 1998 made by this Schedule apply in relation to identity cards issued after the commencement of this item.

Australian Security Intelligence Organisation Act 1979

10  Subsection 38(1)

Omit “information, in the prescribed form,”, substitute “prescribed information”.

11  Subsection 38A(2)

Omit “information, in the form prescribed for the purposes of subsection 38(1),”, substitute “prescribed information”.

12  Application provision

The amendments of the Australian Security Intelligence Organisation Act 1979 made by this Schedule apply in relation to notices given after the commencement of this item.

Banking Act 1959

13  Subsection 69(3)

Omit “and any regulations under subsection (3A)”.

14  Subsection 69(3A)

Repeal the subsection.

Biosecurity Act 2015

15  Subsection 634(4)

Repeal the subsection, substitute:

             (4)  A claim for compensation under subsection (3) must:

                     (a)  if a form is approved in an instrument under subsection (4A)—be in that form; and

                     (b)  be accompanied by the documents (if any) prescribed by the regulations.

          (4A)  The Director of Biosecurity may, by notifiable instrument, approve a form for the purposes of paragraph (4)(a).

16  Application provision

The amendment of the Biosecurity Act 2015 made by this Schedule applies in relation to claims made after the commencement of this item.

Building Energy Efficiency Disclosure Act 2010

17  Paragraph 35(2)(a)

Repeal the paragraph, substitute:

                     (a)  satisfy the requirements prescribed by the regulations; and

18  Application provision

The amendment of the Building Energy Efficiency Disclosure Act 2010 made by this Schedule applies in relation to identity cards issued after the commencement of this item.

Carbon Credits (Carbon Farming Initiative) Act 2011

19  Paragraphs 76(4)(a), (b) and (d)

Omit “regulations or the”.

20  Subsections 76(9) and (10)

Competition and Consumer Act 2010

22  Subsection 10.26(1)

Repeal the subsection, substitute:

             (1)  An application for the provisional registration of a conference agreement must:

                     (a)  be in writing; and

                     (b)  be made to the Registrar in accordance with the regulations; and

                     (c)  contain the information prescribed by the regulations; and

                     (d)  be signed and dated by the applicants; and

                     (e)  be accompanied by the documents (if any) prescribed by the regulations; and

                      (f)  be accompanied by the appropriate prescribed fee.

23  Subsection 10.31(1)

Repeal the subsection, substitute:

             (1)  An application for the final registration of a conference agreement must:

                     (a)  be in writing; and

                     (b)  be made to the Registrar in accordance with the regulations; and

                     (c)  contain the information prescribed by the regulations; and

                     (d)  be signed and dated by the applicants; and

                     (e)  be accompanied by the documents (if any) prescribed by the regulations; and

                      (f)  be accompanied by the appropriate prescribed fee.

24  Subsection 10.35(2)

Repeal the subsection, substitute:

             (2)  The abstract must:

                     (a)  include the title of the conference agreement; and

                     (b)  include the names of the applicants; and

                     (c)  be signed and dated by the applicants; and

                     (d)  satisfy the requirements (if any) prescribed by the regulations; and

                     (e)  comply with any regulations requiring its verification (in whole or part) by or on behalf of the applicants.

25  Subsection 10.40(2)

Repeal the subsection, substitute:

             (2)  The notice must:

                     (a)  be in writing; and

                     (b)  contain the information prescribed by the regulations; and

                     (c)  be signed and dated by the parties to the agreement; and

                     (d)  be given to the Registrar in accordance with the regulations.

26  Subsection 10.43(2)

Repeal the subsection, substitute:

             (2)  The notice must:

                     (a)  be in writing; and

                     (b)  contain the information prescribed by the regulations; and

                     (c)  be signed and dated by the parties to the agreement; and

                     (d)  be given to the Registrar in accordance with the regulations.

27  Subsection 10.49(2)

Repeal the subsection, substitute:

             (2)  The offer must:

                     (a)  be in writing; and

                     (b)  be made to the Minister in accordance with the regulations; and

                     (c)  contain the information prescribed by the regulations; and

                     (d)  be signed and dated by the parties to the agreement.

28  Subsection 10.59(2)

Repeal the subsection, substitute:

             (2)  The offer must:

                     (a)  be in writing; and

                     (b)  be made to the Minister in accordance with the regulations; and

                     (c)  contain the information prescribed by the regulations; and

                     (d)  be signed and dated by the ocean carrier.

29  Subsection 10.64(2)

Repeal the subsection, substitute:

             (2)  The offer must:

                     (a)  be in writing; and

                     (b)  be made to the Minister in accordance with the regulations; and

                     (c)  contain the information prescribed by the regulations; and

                     (d)  be signed and dated by the ocean carrier.

30  Subsection 10.70(3)

Repeal the subsection, substitute:

             (3)  The application must:

                     (a)  be in writing; and

                     (b)  be made to the Registrar in accordance with the regulations; and

                     (c)  contain the information prescribed by the regulations; and

                     (d)  be signed and dated by the ocean carrier; and

                     (e)  be accompanied by a copy of the instrument appointing the agent; and

                      (f)  be accompanied by the appropriate prescribed fee.

31  Subsection 10.72(3)

Repeal the subsection, substitute:

             (3)  A notice under paragraph (1)(a), (b) or (c) must:

                     (a)  be in writing; and

                     (b)  be given to the Registrar in accordance with the regulations; and

                     (c)  contain the information prescribed by the regulations; and

                     (d)  be signed and dated by the ocean carrier; and

                     (e)  be accompanied by a copy of the instrument appointing the agent.

The notice may be expressed to take effect on a specified day.

32  Paragraph 133A(2)(a)

Repeal the paragraph, substitute:

                     (a)  contain the information prescribed by the regulations; and

33  Paragraph 154C(2)(a)

Repeal the paragraph, substitute:

                     (a)  contain the information prescribed by the regulations; and

34  Application provisions

(1)       The amendments of sections 10.26, 10.31 and 10.70 of the Competition and Consumer Act 2010 made by this Schedule apply in relation to applications made after the commencement of this item.

(2)       The amendment of section 10.35 of the Competition and Consumer Act 2010 made by this Schedule applies in relation to abstracts given after the commencement of this item.

(3)       The amendments of sections 10.40, 10.43 and 10.72 of the Competition and Consumer Act 2010 made by this Schedule apply in relation to notices given after the commencement of this item.

(4)       The amendments of sections 10.49, 10.59 and 10.64 of the Competition and Consumer Act 2010 made by this Schedule apply in relation to offers made after the commencement of this item.

(5)       The amendments of sections 133A and 154C of the Competition and Consumer Act 2010 made by this Schedule apply in relation to identity cards issued after the commencement of this item.

Copyright Act 1968

35  Subsection 135AEA(3)

Repeal the subsection (not including the note), substitute:

             (3)  The claim must contain the information prescribed by the regulations.

36  Subsection 135ZZQ(1)

Omit “in the prescribed form”.

37  Subsection 135ZZQ(1)

After “identity card must”, insert “satisfy the requirements prescribed by the regulations and must”.

38  Application provisions

(1)       The amendment of section 135AEA of the Copyright Act 1968 made by this Schedule applies in relation to claims made after the commencement of this item.

Corporations (Aboriginal and Torres Strait Islander) Act 2006

39  Subsection 447‑5(1)

Customs Act 1901

44  Subsection 4(1) (definition of Export entry advice)

Repeal the definition.

(1)       The amendment of section 140W of the Migration Act 1958 made by this Schedule applies in relation to identity cards issued after the commencement of this item.

(2)       The amendment of section 274 of the Migration Act 1958 made by this Schedule applies in relation to documents given after the commencement of this item.

National Environment Protection Measures (Implementation) Act 1998

106  Subsection 40(1)

National Greenhouse and Energy Reporting Act 2007

107  Paragraph 15(d)

Repeal the paragraph, substitute:

                     (d)  be in writing; and

                     (e)  identify the section under which the application is made; and

                      (f)  comply with any requirements prescribed by the regulations.

Repeal the subsection, substitute:

             (2)  The registered corporation or the other person may apply to the Regulator for a determination under subsection (3). The application must:
