A Bill for an Act to amend the Northern Territory (Self‑Government) Act 1978 and repeal the Euthanasia Laws Act 1997, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act is the Ensuring Northern Territory Rights Act 2021.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this Act

The day after this Act receives the Royal Assent.

 

Note:          This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act.

             (2)  Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.

3  Object

                   The object of this Act is to deliver people living in the Northern Territory the same rights as people who reside in Australian states.

4  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Part 1Amendments of the Northern Territory (Self‑Government) Act 1978

1  Subsection 50(1)

Repeal the subsection.

2  Section 50A

Repeal the section.

3  At the end of subsection 53(4)

Add:

Note:          Sections 29 and 40 of the Fair Work Act 2009 deal with inconsistency between awards and agreements made under that Act and laws of the Territory.

4  Subsections 53(5) and (6)

Repeal the subsections (including the note).

Part 2Repeal of the Euthanasia Laws Act 1997

5  The whole of the Act

Repeal the Act.

Part 3Application

6  Application—repeals relating to euthanasia laws

(1)       Despite the repeal of the Euthanasia Laws Act 1997 and section 50A of the Northern Territory (Self‑Government) Act 1978 by this Schedule, the Rights of the Terminally Ill Act 1995 (NT):

                     (a)  continues to have effect as a law of the Territory in relation to any act or thing that was done before 27 March 1997; but

                     (b)  has no force or effect as a law of the Territory in relation to any act or thing done on or after that day.

Note:       27 March 1997 is the day the Euthanasia Laws Act 1997 received the Royal Assent.

(2)       Subitem (1) applies subject to a contrary intention in a law of the Northern Territory that is enacted after the commencement of this item.
