A Bill for an Act to amend the Migration Act 1958, and for related purposes
The Parliament of Australia enacts:
1 Short title
This Act is the Migration Amendment (Common Sense for All Visas) Act 2021.
2 Commencement
(1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Schedules
Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
Schedule 1—Amendments
Migration Act 1958
1 At the end of section 40
Add:
Provisions applying until 31 December 2021
(4) A requirement of this Act or the regulations that a visa, or a visa of a specified class, may only be granted to a person who is in Australia at the time of grant does not apply if the visa is granted:
(a) on or after the commencement of this subsection; and
(b) on or before 31 December 2021.
(5) A requirement of this Act or the regulations that a visa, or a visa of a specified class, may only be granted to a person who is outside Australia at the time of grant does not apply if:
(a) the visa is granted:
(i) on or after the commencement of this subsection; and
(ii) on or before 31 December 2021; and
(b) the person is not in immigration clearance at the time of grant.
(6) For the purposes of subsection (4) or (5), it does not matter whether the application for the visa was made before, on or after the commencement of this subsection.
(7) To avoid doubt, subsection (4) does not affect any requirement that the person not be in immigration clearance at the time of grant.
