South Australian Heavy Vehicle Standards (Rear Lighting Requirements for Roll-On/Roll-Off Vehicles) Exemption Notice 2020 (No.1)

1.       Purpose

The purpose of this notice is to exempt a heavy vehicle to which it applies from certain requirements of the Heavy Vehicle (Vehicle Standards) National Regulation (the National Regulation).

2.       Authorising Provision

This Notice is made under section 61 of the Heavy Vehicle National Law (the National Law) as in force in South Australia.

3.       Title

This Notice may be cited as the South Australian Heavy Vehicle Standards (Rear lighting requirements for Roll-On/Roll-Off Vehicles) Exemption Notice 2020 (No.1).

4.       Commencement

This Notice commences on 10 February 2020.

5.       Expiry

This Notice expires on 9 February 2022.

6.       Definitions

(1)    Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the National Law.

(2)    In this Notice –

roll on/roll off vehicle means a vehicle  with a manufacturer’s Gross Vehicle Mass exceeding 4.5 tonnes, used to transport waste products or scrap metal.

7.       Application

(1)    This Notice applies in South Australia only.

(2)    This Notice applies to roll on/roll off vehicles.

 

8.       Exemption from Prescribed Vehicle Standards

(1)    A roll on/roll off vehicle is exempt from complying with Schedule 1 Section 2(1) of the National Regulation insofar as it requires compliance with Australian Design Rule (ADR) 13/00 for a type of light or reflector mentioned in Column 2 of Table 1, to the extent listed in Column 3.

(2)    A roll on/roll off vehicle is exempt from complying with the corresponding section of Schedule 2 of the National Regulation as mentioned in column 4 of table 1.

9.       Conditions

(1)    The vehicle is only permitted to travel on a road or road related area for the purposes of:

(a)      Undertaking activities associated with the transport of waste products or scrap metal; or

(b)     Transporting the vehicle to or from a place of storage, maintenance or repair.

(2)    This exemption is only valid while a bin is being transported on the vehicle and the “loading frames” do not protrude beyond the rear of the bin.

Note - If the vehicle is driven on a road or road related area in circumstances other than those specified in this notice (such as being driven without transporting a bin), this exemption does not apply and all lighting equipment requirement under the National Regulation, as applicable, must be fitted to the vehicle. A temporary lighting board may be attached to the rear of the vehicle in such circumstances.

(3)    Rear lighting equipment is to be fitted no further forward than 1600 millimetres from the rear of the vehicle.
